Relevant Motions deferred from Development Plan Direction Meeting 20th April 2009
These motions relate to matters that were deferred from the Development Plan direction meetings that were held in April 2009. A short report is attached to each.
Motions
Amend 0.1.1(Background) by inserting additional wording so that the paragraph reads “Central to this section is addressing the twin issues of employment and renewable energy as well as the traditional core land-use strategy for the County.”
That Section 0.3.11 on page 16 be amended as follows: Replace the 2nd sentence in the 1st paragraph with "In the preparation of this Development Plan the Council has ensured that the Plan complies with the Regional Planning Guidelines for the Greater Dublin Area and other regional plans and strategies.
Amend 0.2.(Core Strategies) by inserting after economic base “the maintenance of existing jobs and the creation of new employment opportunities and the exploitation, development and delivery of renewable energy, particularly given its potential and the unique geographical position of this County, by piloting Geothermal Energy for and within the County”.
Amend 0.2. (Core Strategies) by inserting after “Dublin – Cork Railway Line” a new clause to replace existing as follows “in relation to our prime natural and heritage environment we need to provide additional safeguards for the Dublin Mountains, the Liffey Valley, the Dodder Valley and our Canal waterway.”
That the following amendment be made to Section 0.2 on page 11: amend the third bullet point after "This will entail the following:" to read "Supporting continuing agricultural activity in the west of the County, and facilitating new activities including market gardening."
Amend 0.2. (Core Strategies) by adding an additional bullet point after “County Town of Tallaght” as follows “the preservation and maintenance of our traditional Villages of Lucan, Clondalkin, Palmerstown, Newcastle, Rathcoole, Rathfarnam, Templeogue and Brittas”
Amend 0.2. (Core Strategies) under “a” add an additional bullet point: “supporting, promoting and actively developing sources of renewable energy more specifically given our geographical location, Geothermal Energy.”
In Section 0.2.1, on page 12, in the paragraph after (g), beginning with "Given the above..", insert after "large scale", and in brackets the words "(greater than 10 hectares)".
In Section 0.2.1, in the last paragraph beginning with "South County Dublin has significant..", amend the 3rd sentence, beginning with "The Development Plan.." to read "The Development Plan will support development within these villages consistent with their continued function and the existing zoning of the lands concerned.".
Amend 0.2.1. (A Living Place) by adding an additional point (h) “In considering re-development or in-fill in long established communities and settled developments, to maintain a balance between the competing forces of National or Regional Guidelines and the need to protect and enhance the quality of life that has either attracted residents to a particular community or has been developed by that community over a period of years or generations.”
That the following amendment be included in the written statement.
0.2.4 A Protected Place
The County Development Plan continues to support and maintain our natural and human history through the continuation of existing policies including the protection of the Dublin Mountain uplands and the Liffey Valley add Dodder Valley
In Section 0.2.4 on page 13 replace the word "history" in the 3rd line with "heritage".
Amend 0.2.5. by replacing the second sentence with “In practice the twin response of the County Development Plan to climate change is the development of renewable energy and more compact Urban forms”.
Amend 0.2.6. by inserting a new bullet point after the first: “creation of dedicated routes for heavy commercial traffic removing it from built-up residential areas and proximity to schools.”
Section 0.3. This Council calls for the a new County Development Plan that has the various EU, National and Regional Guidelines and Strategies fully and explicitly integrated and referenced throughout the document.
In Section 0.3.20, on page 19, add an additional sentence to the last paragraph, after "other plans and studies as appropriate", as follows: "The Council will encourage and support the participation of local communities, in historic villages such as Palmerstown, Newcastle, Rathcooole, Clondalkin, Rathfarnham, and Tallaght in Village Design Statement projects."
That the following amendment be included in the written statement:-
0.3.20 Local Area Plans, Studies and Strategies
Local Area Plans and approved plans are prepared by the Council for new development areas. Add and for older areas if desired.
Amend 0.4.5. (Middle Paragraph) with an additional sentence “Where a pre-planning consultation takes place, the Council shall not then have resource to requesting additional information (however it can seek clarification) but make a judgement call based on the basic application”.
Under Pre-Planning Consultation, ref. 2.3 - to propose the addition of the following sentence "It is the policy of the Council to reply to Pre-Planning Consultation within a three-week period"
That the following amendment be included in the written statement:-
0.4.5 Applications for Planning Permissions
Delete within the limits of staff availability (as this proviso applies to all works).
In Section 0.4.6, in the first paragraph, delete the phrase "where it is appropriate to do so,".
Amend 0.4.6. by adding an additional bullet point: “Notify complainants regards the progress (or lack of it) and the eventual outcome of the proceedings”.
That the following amendment be included in the written statement:-
0.4.6 Enforcement
Add "and will carry out periodic site visits in order to ascertain compliance."
"That the Plan defines what "sustainable layout and design and adequate public transport links" equate to providing examples per 5,000 population or similar equation in relation to 1.2.1.".
At section 1.2.4. point 5 remove 'accommodation' and insert 'Social Housing units'.
That the following amendment be included in the written statement:-
Table 1.2.4: Proposed Traveller Accommodation
Owendoher, Ballyboden
Should be in section - Existing traveller accommodation.
"That the Plan provides examples as to how the Council "supports a range of appropriate renewable energy resources" in relation to 1.2.6. and what measures are being taken to realise the delivery of same".
Amend 1.2.6. by adding “and by the exploitation of renewable energy particularly, but not only, Geothermal”.
1.2.11 (Traveller Accommodation Programme) Amend to include, 'That the Traveller Accommodation Programme 2009-2013 will make provision for prioritising where possible developments that were due to be commenced and completed in the T.A.P 2004-2008 but were not delivered on'.
At section 1.2.12i point 9 amend to include 'whilst protecting essential amenities and valued open space'.
At section 1.2.12i point five remove 'reasonable' and insert 'a high grade' in relation to the protection of existing residential amenities.
At section 1.2.12i point ten amend to include 'whilst consulting and listening to the concerns and coherent arguments of the rural Communities concerned.'
Amend 1.2.12. At the eighth bullet point add in “only” between “densities” and “at”.
Amend 1.2.12. by adding an additional bullet point before the last one: “Strictly manage the re-development of areas to ensure that the views of residents have a real opportunity of being made known (by the development and use of a transparent process), that they are fully taken into account and that the character of the area is not seriously altered”.
Amend 1.2.13.1 by adding in after in general: “having due regard to the existing ambiance of the area”.
Section 1.2.14.vi Policy H6, add the following paragraph, after "in close proximity":
"A Local Area Plan will be drawn up and adopted to control any such proposed infill development, where the area of land considered for development is greater than 2 hectares."
Under Housing, Section 2, ref. 1.2.14.i - Policy H1 - proposed to insert second sentence as follows "Exceptions will include where transport corridors are alongside high amenity areas, e.g. on the N4 at the Liffey Valley, incl. St. Edmundsbury and Woodville."
Amend 1.2.14.i by changing “to encourage” to “be open to” and drop “at suitable location”.
Under Housing - Section 2 - 1.2.14.v - to ad "when there is prevalent Anti-Social Behaviour in this area."
1.2.14.vi (Infill Housing in Council Estates) Amend to include: "That this policy will only be pursued where in-depth consulation takes place with the relevant Communities concerned and when examining nearby alternative usable open space takes in to account all age groups. This policy will be pursued in accordance with the same standards as apply to private Estates i.e building heights, building lines etc"
That the number of homes to the acre be set to 10.
That the following amendment be included in the written statement:-
1.2.13.i Appropriate Locations for Increased Densities:
Inner suburban/infill add – where appropriate
Section 1.2.24.i Policy H14. Add the following sentence, after "objectives of this Plan.": "Such infill developments will be subject to a Local Area Plan, where the scale of a proposed infill development is significant relative to the size of the existing area and the number of existing residential units."
That the following amendment be included in the written statement:-
1.2.26.i Policy H15: Backland Development
Delete -by a single developer
Amend 1.2.25. by adding a new paragraph: “The Council will conduct a study into the feasibility of backland development across the County and make the results known to the public.”
Amend 1.2.27 by adding to the second bullet point “except where a separate dwelling unit would not undermine any of the other principles”.
1.2.41 (Social and Affordable Housing) Amend to remove '15%' and insert '20%'.
That increased densities permitted along QBC routes shall not apply until QBC route is fully completed and operational.
That the development of residential units in excess of 2 storeys be prohibited within 100m of existing two-storey houses in all residential areas.
That the following amendment be included in the written statement:-
1.2.20.i Policy H12: Conservation of Existing Housing Stock
Add after character – culture & historical
That the current Development Plan contains a specific reference to the West Tallaght area aiming to improve the tenure mix and to ensure no further stratification of social housing and unregulated rental of private housing - in keeping with the proper planning and sustainable development of the West Tallaght area.
That during the lifetime of the plan that an emergency crisis homeless facility be established and prioritised in the South Dublin County Council area
That the Plan will take cognisance of age and health of many residents living in the rural area of the County and will take cognisance of the need of these families and their relatives in housing applications in future housing applications.
That the Plan makes provision and includes for the Bohernabreena/ Glenasmol area amendments to include people who comply with the requirements/criteria of the existing Plan that they may be considered for housing even if they currently reside in another dwelling.
That the Plan makes provision for and includes for the Bohernabreena/ Glenasmol area amendments to include people who currently support seriously ill or elderly parents and don't comply with the requirements/criteria of the existing Plan because of recent decisions and that they may now be considered for housing even if they currently reside in another dwelling outside the immediate area.
That relevant criteria should be as listed in the Bohernabreena study with the following amendments:-
1.Those who care for immediate elderly or family member with medical needs and can demonstrate that they have ongoing social/familial ties with the community should the medical condition change
2. If a person is granted planning approval in the study area and they own a dwelling, no building works should commence until this dwelling is legally disposed of. A timeframe of 2 years will be only allowed from the date of approval.
To reconstitute section 1.2.55 on ‘Taking in Charge’ as a specific policy objective and to add the following additional sentence “In the case of multi-unit residential developments where a private property management company is to be employed it shall be the policy of the council to take-in-charge any playgrounds, parkland and urban spaces surrounded by non-residential ground floor uses where these spaces are fully-accessible to the wider public and it could be reasonably expected that they would be regularly used by non-residents."
That the following amendment be included in the written statement:-
1.2.55 Taking in Charge
Delete the words ‘as quickly as possible’ and insert the words within three years (or no. of years to be agreed in discussion) of occupation of first homes.
Amendment to 1.2.60 POLICY
Change to:
"1.2.60.i Policy H41: Naming of Housing Developments
It is the policy of the Council that the naming of any new residential development will reflect the local and historical context of its siting and should include the use of the Irish language."

In relation to that which is permitted under various zonings, this Council determines that the following amendments be made to A1 Zoning by removing open for consideration “Cash and Carry/Wholesale Outlets, Heavy Vehicle Car Parks and Refuse Transfer Stations.”
Addendum to 1.3.3.iii Older People - paragraph now to read (addendum in italics);
1.3.3.iii Older People
South Dublin County has a small, but growing, number of older people. The proportion of the population aged 65 and over increased from 6.3% in 2002 to 7.2% in 2006. The Housing Strategy proposes to cater for this group with the continued provision of appropriate housing including sheltered housing close to community facilities and public transport. Good design is also important in creating a safe and barrier-free environment which is easily negotiable by older people. It is furthermore the policy of the Council to ensure adequate development of appropriate commercial and community facilities and public transport in population centres with higher proportions of older people.
Addendum to 1.3.4 - Cultural, Recreational and Leisure Facilities
Second paragraph now to read (addendum in italics);
There is also a good range of sports and cultural facilities available in the County, including the National Basketball Arena, several swimming pools, all-weather pitches and libraries and the Civic Theatre, Tallaght. There are 29 Community Centres, 3 sports and Leisure Centres and 8 Neighbourhood Centres in the County. There are 7 libraries, mobile libraries and the newly opened Red Rua Arts County Centre. Tallaght and Clondalkin Sports and Leisure Centres have recently opened and provide swimming pools, gym activities and playground facilities to the surrounding communities. The opening of Tallaght Stadium further adds to the sporting infrastructure of the county. It is the policy of this Council to facilitate and promote social inclusion and community development through sport, leisure and the arts.
That the following amendment be included in the written sttement:-
1.3.4 Cultural, Recreational and Leisure Facilities
Change Red Rua Arts county centre to: Rua Red South Dublin Arts Centre
1.3.6. (Strategy) Amend to include the insertion of 'and enhancement' between 'retention' and 'of existing' in relation to services in disadvantaged areas.
To include within section 1.3.19 on ‘School and College Sites’ the details of any future education demand forecasting, in particular for second-level education demand, as prepared in collaboration with the Department of Education in accordance with ‘Provision of Schools and the Planning System, A Code of Practice for Planning Authorities’ (2008).
That it be a specific objective of South Dublin County Council's Development Plan to draw up a strategy to work with the Department of Education to ensure a rolling construction programme in the Tallaght South area of schools on sites that have been identified consistently through this Council's Development Plans.
That the following amendment be included in the written statement:-
1.3.21 Childcare Facilities
for every 75 dwelling units in new housing areas with a capacity for 20 children. Delete the following words : “However, depending on circumstances this requirement may be varied”
That, in view of the meaning given to the term Childcare in the first paragraph of Section 1.3.21 on page 59, the heading be amended to read: “Childcare and Pre-school Facilities”.
That Section 1.3.20.iv be amended as follows: After the words “significant improvements to be made” delete “in conjunction with principles(sic), teachers, parents/guardians, boards of management and pupils” and replace with “the VEC, school boards of management, principals, teachers, parents/guardians and pupils.”
Amend 1.3.20 ii by adding: “Where requested to do so by parents acting through their local Councillors, the Council will promote the provision and/or expansion of a school to meet local needs”.
Add an additional policy to Section 1.3.22, after 1.3.32.ii, as follows:
"It is the policy of the Council to encourage and facilitate the involvement of local communities/park users in the management of parks and open spaces."
That this Council will amend the Draft Development plan by deleting the words “should be considered” contained in1.3.22.iv in both instances and replacing them by the words “should be catered for”.
That the following amendment be included in the written statement:-
1.4 The County is currently poorly provided with children’s playgrounds ADD Rathfarnham Castle Park playground.
That this Council adopt the policy of considering the provision of shared community and childcare facilities on sites made available to the Department of Education and Science for schools.
That the Plan agrees to actively encourage and enhance current childcare and its affordability in the County with a view to doubling the availability of spaces in the County during the lifetime and existence of the Plan.
That an additional Policy be added to Section 1.3.22 as follows: 1.3.22.xiii Policy SCR26: Location of Childcare and Pre-school Facilities
"It is the policy of the Council to facilitate and support through the planning process the location of childcare and pre-school facilities on the same campuses as Primary Schools, or adjacent to Primary School campuses."
Addendum to 1.3.25 Libraries - 3rd paragraph now to read (addendum in italics);
The public library service is an important focal point at the heart of the local community and aims to be pro-active and dynamic in addressing a variety of needs, particularly in the areas of information, culture and heritage, literature and lifelong learning. It is also intended that the public library service will become a focal point for re-training, re-skilling and upskilling for those seeking new employment.
Amend 1.3.25. by deleting from the last sentence “and to satisfy the Department of Environment, Heritage and Local Government criteria”.
In Section 1.3.41 Allotments add the following sentence to the 2nd paragraph, after “within the park.”: "It is an objective of the Council to examine the making of leases or other arrangements with farmers and owners of agriculture zoned land to facilitate and expand opportunities for residents of the County to rent sites for allotments.”
That this Council will amend the Draft Development plan by inserting the words “and that these spaces will be protected from future planning” at the end of the paragraph 1.3.32.iii.
To amend policy SCR37 on ' Green Route Networks' as follows:
- After the words “by utilising links through parks, open spaces and roads” to add the following additional wording “and where appropriate through lands subject to large scale development or regeneration under approved plans and through well-landscaped Enterprise Priority 2 zoned lands”
- To add the following additional objective “the council shall seek to develop a green route lining the Liffey Valley at Lucan Village to the Dublin Mountains via Griffeen Valley Park, Grange Castle Business Park, Corcagh Park, Citywest Business Park and Saggart Village.
That on page 67 – Policy SCR49, “and Keep Ireland Open” should be added after “Committee” on 7th line and that the Draft County Development Plan is amended accordingly.
Amend Section 1.3.36.viii on page 67 as follows: After “County” add the words “including pitches and facilities for minority sports including cricket and baseball.”
That the Plan encourages, supports and agrees to facilitate the long term viability and sustainability of the swimming pool in East Tallaght.
That trees that are over developed be removed from estates. The Council does not have the money to cut them down. it will save money in the long term. There are better places to plant these trees. They are unsuitable for residential areas.
That the Plan encourages and facilitates an assessment of all Local Authority housing stock in the County with regard to access for those who are elderly or have physical impairments.
That the following amendment be included in the written statement:-
1.3.36.ix Policy SCR47: Swimming Pools
Add it is an objective to have at least one swimming pool initially in each electoral area within the County .
Amendment to 1.3.36.iv Policy SCR 42: Skateboard Parks.
Change to:
"It is the policy of the Council to provide at least one Skateboard Park in each Electoral Area within the County. The location and nature of these parks will be developed in consultation with potential users of such facilities, local councillors and local residents."
That this Council delete 1.3.38.vii from the Draft Development Plan.
That in all areas zoned residential of mixed development that a proportionate area of land be provided for allotment use where the development proposed is substantially or completely apartment style development.
It is the policy of this Council to provide playground facilities in all public parks throughout the County.
That the following amendment be included in the written statement:-
1.3.40.i Policy SCR 57: Use of Off-Road Motor Vehicles
Add after the word recreational – and driver educational facility.
That this Council will amend the Draft Development Plan by deleting the word “maturing” from 1.3.42.i and inserting the words “promote and” immediately before the word “extend” in the same paragraph.
Addendum to 1.3.43 Community Gardening - Section now to read (addendum in italics);
The Council has successfully assisted local residents with the development of community gardens at various locations within the County.
Community Gardens have thus far been developed in South Dublin County as a result of interested people in a community coming together to practice horticulture- growing fruit, vegetables and flowers. Community gardening, as well as providing a leisure outlet for residents, also contributes to sustainable food produce and the visual and environmental amenity of local communities.
Policy SCR 59: Community Gardening
It is the policy of the Council to assist and support residents and residents’ groups in forming and developing community gardens at appropriate locations in the County. The Council will provide, where possible, material assistance and advice to groups involved in community gardening and assist with sustainable water solutions.
That the plan will promote and facilitate the proper upkeep of cemeteries under the control of South Dublin County Council and ensure the adequate provision of burial spaces and other preferred alternatives in the County area.
That the following amendment be included in the written statement:-
1.3.46.i Policy SCR60: Circus & Funfair Events
Add – excluding those circuses with wild animals.
That the Plan will encourage and agree to pursue during the lifetime of its operation the establishment of a Gaeltacht in the County area
That the Plan encourages and will facilitate the concept of good neighbours and neighbourhoods and the issuing and promotion of a Charter of Good Behaviour involving residents to encourage an inclusive community spirit and agrees to establish a pilot in the Springfield area of Tallaght that currently has a large proportion of rented housing.
That it is the policy of SDDC to promote and support communities under pressure from criminal and anti social behaviour and the plan agrees to support and encourage the facilitation of CCTV at the senior citizens facility at Glenview Lodge,Tallaght.
That the Plan encourages and agrees to establish during its lifetime a forum to include more local involvment in the planning process from local resident groups and their representatives.
In Section 1.4.14 Street Networks, add a paragraph after “public transport and the car.” At the end of the first paragraph, as follows:
“The Development Plan will incorporate the principles set out in the policy document on cul-de-sacs adopted by the Council.”
To amend section 1.4.14.ii on ‘Existing Cul-De-Sacs’ to add an additional bullet point as follows: “A proposal for the opening of an existing cul-de-sac in an estate taken-in-charge by the council will require the agreement of the elected members of the council on foot of report by the Manager following an appropriate period of public consultation.”
To add the following additional bullet point to section 1.4.16.i ‘Determining Building Height’: “The layout of new higher-density residential developments immediately adjoining areas of existing one and two-story housing should seek to ensure a gradual change in building heights with no significant marked increase in building height in close proximity to existing housing. In particular, new housing immediately next to or backing onto existing one and two storey housing and sharing a common rear or side garden boundary should have no more than two storeys in height while new housing creating a strong urban edge to a main road or street and facing existing one and two storey housing opposite should be no more than three storeys in height."
That a moratorium be implemented OR that planning permission is required for cobblelock driveways. These are causing more and more floods throughout our County.
That this Council will amend the Draft Development Plan by inserting the words “and security on all aspects of the property” after the word “privacy” contained in 1.4.19.i.
That this Council will amend the Draft Development Plan by inserting the words “anticompetitive practice and” after the words “To avoid” contained in 1.4.25.iv.
Under Transportation - Roads section. ref. 2.2.6 - proposed "This Council proposes to examine the proposed West Ring Road as proposed by Lucan Planning Council as an alternative to the existing proposal to extend the Celbridge Road, through the Liffey Valley to Fingal"
To add a new policy objective to section 2.2.9 as follows: “It is the policy of the council to work with Dublin Bus to seek the provision of a regular bus service linking Lucan with Tallaght along the Outer Ring Road QBC.”
To add a new policy objective to section 2.2.9 as follows: “It is the policy of the council that QBC’s and dedicated bus lanes should only be in operation during peak morning and evening periods and that they should be open to other traffic at all other times.”
In Section 2.2.11 Policy add a new Policy, after 2.2.11iv as follows:
"2.2.11.v
It is the policy of the Council to implement, during the term of the Plan, a Pilot School Bus Service in the County, based on the model already developed by the Transportation SPC."
LUAS ref. 2.2.11.i - To propose an amendment to the first sentence that will now read: "It is the policy of the Council to prioritise, promote and facilitate the extension of the LUAS to serve the Lucan and Palmerstown areas, and to convey to the Dublin Transportation Office (DTO) transportation strategy."
To amend Policy T5 on ‘Luas and Light Rail Transit Extensions’ to replace the first sentence of the policy as follows: “It is the policy of the Council to promote and facilitate the extension of Luas to serve the Lucan area initially along the preferred route identified by the Rail Procurement Agency and to work with the Agency to seek a further extension of this preferred route from its current proposed terminus at Newcastle Road to Lucan Village.” And furthermore to replace the reference in section 3.3.19.i to the ’Dublin Transport Office’s proposals’ with reference to the ‘Rail Procurement Agency’s proposals’.
That this Council enables the users of multi-modes of transport by providing facilities at strategic transition points.
That this Council will ensure that access to major pieces of social infrastructure in the County Town is made easier for inhabitants particularly on the fringe of the county.
2.2.11.i (Policy T5 Luas and LRT Extension) In relation to the aspired to extension of Luas to the Old Bawn area - Amend to include 'and the parishes of Jobstown and Killinarden'.
That the Plan will take cognisance of the age group currently living in many rural areas of the Council and will encourage greater public transport links in the County.
That the Plan in view of the current proposals to cut public bus services in the Kingswood area agrees to facilitate and promote the maintenance of these vital transport links for many residents including elderly living in the area.
That the Plan takes cognisance of people with disabilities and agrees to promote and support bus links from Kingswood to the City Centre for employment opportunities.
That on page 101 – 2.2.14, the section be re-written and divided into three sections:
A Walking and Cycling;
B Walking
C Cycling
In addition to material in the section the following should added: “
A Walking and Cycling
Also draft DLR – 12.1.12.
1 Walking and Cycling will be promoted by securing the development of a network of safe cycle routes and footpaths on new and existing roads and on routes reserved exclusively for pedestrians and cyclists.
2 New Walkways and cycle routes should be established on a legal and permanent basis.
3 Road safety for pedestrians and cyclists would be improved by lower speed limits and priority over motorised transport and by providing linear parks, footpaths, cycle paths and public lighting in towns and villages and Footpaths on the outskirts of towns and villages should be extended where appropriate, and adequate public lighting should be provided.
4 Develop linkages with walking and cycling trails such in adjoining counties.
5 Walking/Cycle Routes should be signposted/waymarked
6 Develop a network of rural footpaths, cycleways and bridle paths.
7 Allow rural landscape into urban landscapes through greenways and linear parks.
8 Protect and promote Greenways and consider designating them as public rights of way.
B Walking
1 National Trails Network, Slí na Sláinte and other defined walking trails and cycle routes should be listed
2 Work in partnership with local authorities in adjoining counties to provide a network of walking trails beyond the county boundaries.
3 Facilitate the provision of car parks for walkers at appropriate access points to amenities.
4 Research and map the existing network of traditional paths used for leisure purposes with the intention of determining the legal basis and status of their use.
5 The Council shall establish a Register of all walking routes and preserve protect and add additional walking routes.
7 Maps showing walking routes should be included.
C Cycling
Cycle routes should follow, in order or preference: Off-road tracks, quiet country roads, and regional or national roads.
And that the draft county plan is accordingly amended.
That on page 101 – 2.2.14 – penultimate paragraph, “ To respect the European Charter of Pedestrian Rights” be replaced by “ To comply with the European Charter of Pedestrian Rights(1998) as reproduced in Appendix 7.” And that the draft county development plan be amended accordingly.
To add the following to Table 2.2.2 Cycle route objectives:
- Lucan Road – From Junction with Outer Ring Road to the junction with Old Hill;
- Willsbrook Road – Extension of proposed route from junction with Mount Bellew Way to junction with Outer Ring Road and Ballyowen Road;
- Outer Ring Road – From junction with Lucan Road to junction with Willsbrook and Ballyowen Road;
- Newcastle Road – From junction with Castlegate Way to junction with Esker Drive;
.
It is the policy of this Council to provide cycle paths in all public parks throughout the County to encourage our young children to learn the benefits of cycling on designated lanes in a safe environment.
Under Transportation, Section 2, under park and ride facilities (bullet point no. 6) - proposed to change this item to "This Council makes a firm commitment to pursue as a matter of urgency the provision of park and ride facilities."
That it shall be an objective of the new County Development Plan to address the impact on the quality of life that “through” traffic is having on our citizens and in particular to set targets for achieving within three years from the date of adoption of the plan that:
- Identify undesirable levels of commuter and other outside traffic through residential areas and to begin to put in place measures that ameliorate them
- Propose and begin to implement options for the re- routing of traffic away from schools and other sensitive areas
- Examine the impact of installing Bus/Public Vehicle Gates at certain locations throughout the County effectively providing “Cul-de-Sac” residential communities and to follow through by putting in place an number of pilot projects that achieve this objective
- Provide ready access to national routes for motorised traffic for residents from our communities that will both minimise commuting distance and facilitate integration
This Council will, in association with the NRA, provide signage on primary routes within the County to indicate to motorists the distance to the nearest petrol station/s.
That the opening of the Barney's Lane Link Road be included as an objective.
To add the following to table 2.2.5 ‘six year road objectives’:
(i) Service road exit from Tandy’s Lane (Ardeevin) to N4 Eastbound
(ii) Service Road entry/exit from Esker Lane to N4 Westbound
That it shall be an objective of the new County Development Plan to alleviate the traffic situation in Lucan Village and to remove through heavy commercial traffic from the village and its environs by entering into negotiations with neighbouring Local Authorities for the provision of a “Western Route” from the N7 to the M4 and that Table 2,2,5 and Table 2.2.6. of the Managers Draft Plan be suitably adjusted to reflect this priority.
To remove the following from table 2.2.6 ‘long term road objective’: ‘Esker Lane to Esker Meadow View’; and to add a new specific local objective to facilitate provision of car-parking, a drop-off point and school accommodation on lands adjacent to Gaelscoil Phadraig currently subject to the above road objective.
Under Section 2.3.4 - Water Supply and Drainage - to include "It is the policy of this Council to actively pursue and resolve water leakage."
That the following amendment be included in the written statement:-
2.3.19 Taking in Charge
It is an objective of the Council to co-operate with adjoining local authorities to prepare an appropriate ‘Taking in Charge’ procedure
Amend section 2.4.3 Waste Management Strategy to include:
“The County shall set it as policy priority to exceed the recycling and composting targets in the Waste Management Plan and to provide leadership in this area.”
Amend all sections in relation to Waste Management so that, where the terms 'meet' or 'achieve' targets are used in relation to recycling or composting; they should instead read 'meet or exceed' and 'achieve or exceed', so that the targets need not limit the levels of recycling or composting in the County.
Delete the following paragraph: in section 2.4.5 Waste Plans
“The Waste Management Act, 1996 (as amended), empowers the County Manager to decide to grant planning permission for development which is consistent with the provisions of, and is necessary for, the proper implementation of the Waste Management Plan for the Dublin Region 2005-2010 (or as may be amended from time to time), but which in the opinion of the County Manager would contravene materially any other objective of this Development Plan."
It shall be an objective of the new County Development Plan that SDCC will not enter any contractual obligation over one year to provide waste to an incinerator - lest it negatively impact on our flexibility to move toward more sustainable waste management.
It shall be a policy of the new County Development Plan that SDCC will not enter any contractual obligation over one year to provide waste to an incinerator, and to expilicitly state this in the County Development Plan.
The County Development Plan shall specifically state that no further waste-to-energy incinerator or waste-to-energy thermal treatment facility be situated in the County.
Section 2.4.2. to be amended to include the following :
“That while the County Development Plan conforms to the Waste Management Plan, in drawing up a new or revisions, or updates to the Waste Management Plan, it is specifically noted that a Waste Management Plan is bound in accordance with Section 22, subsection 7 of the Waste Management Act 1996, whereby it states clearly how the Waste Management Plan must have regard to the policies, objectives and priorities assigned by the Local Authority or Authorities in relation to assisting the prevention and minimisation of waste, the management of same and measures to be undertaken etc: and in so doing, recognise that this County in this Development Plan, has expressed policy, requirements and measures to implement incremental targets and solutions within the life of the plan so that no recyclable or compostable waste from the county be incinerated at any location, and that no further waste-to-energy incinerator or thermal treatement facility be situated in the county, and that contracts with incinerators be limited in timescale”
That the new County Development Plan should include aggressive incremental targets to ensure that within the life of the plan - that we achieve the target that no waste generated within the County that is recyclable or compostable will be incinerated in any location.
The use of terms re-use and re-cycling in the County Development Plan shall be considered to include composting.
Amend the 1st paragraph of section 2.4.11 Waste Re-use and Recycling to read as follows:
“The Council will co-operate with other agencies both public and private in viable schemes for the extraction of useful materials from refuse for use or recycling or composting and will adopt the targets set out in the Waste Management Plan for the Dublin Region 2005-2010 and subsequent updates or revisions as a minimum, and provide leadership in this area.”
Amend the 5th paragraph of section 2.4.11 Waste Re-use and Recycling to read as follows:
“By agreement with other Local Authorities and agencies and subject to the availability of finance and partnership arrangements it is intended to see the following as a priority for the County”
Amend the 5th paragraph of 2.4.11 Waste Re-use and Recylcing to read as follows by including the following additional bullet point:
- Develop a countywide network of green-waste centres in suitable locations to expand the collection system for compostable waste. Incentivise the use of the green-waste centre, by making it cheaper for the user to dump green waste at a green-waste facility rather than their grey-bin or landfill collection.
Amend the final paragraph of 2.4.11 Waste Re-use and Recylcing to read as follows:
“It is the policy of the Council that no waste generated within the County that is recyclable or compostable will be incinerated at any location. This will be achieved through a strict adherence to the EU Waste Hierarchy which places recycling (which includes composting) ahead of energy recovery (which includes incineration).”
with the remaining text of the paragraph to be deleted for the purposes of clarity.
Amend Section 2.4.13 Municipal Solid Waste Disposal to read as follows:
“The Council intends that the safe disposal of waste, which cannot be re-used or recycled or composted, shall be carried out in the manner as stated in policy ES6 below. This approach reflects European policy where it is recognised that ‘waste to energy’ (energy recovery) where it meets specified energy production levels is not regarded as disposal.”
with the remaining text of the paragraph to be deleted.
Under Environmental Services - Section 4 - ref. 2.4.21 - to include "and crematoriums."
Add the phrase “and a policy of mandatory enforcement” to section '2.4.18.ii Policy ES9: Unauthorised Waste Disposal', and include reference to the private and commercial sectors' so it reads:
“It is the policy of the Council to eliminate all unauthorised waste disposal within the County and to regulate and control the disposal of all builders’ spoil and rubble arising within the County by developing sustainable recycling and waste minimisation services and infrastructure through ongoing co-operation with the private, commercial and construction sectors, and a policy of mandatory enforcement”
That in view of large amount of illegal landfill sites being discovered ongoing throughout the County that Plan will encourage during its lifetime a strategy that will lead to the identification and legal pursuance of all the individuals involved.
Add a new policy objective to section 2.5.5 on Overhead Cables as follows: “It is the policy of the council to work with Eirgrid to seek the placing underground of the high-power voltage line between the Adamstown and the boundary with Dublin City Council."
2.5.6 Telecommunications That the plan will encourage and promote an immediate and speedy response through the Courts of landowners and companies involved in the establishment of illegal telecommunications masts
That the decision of granting permission for masts be given to a vote by the Councillors.
2.5.8 (Telecommunications Antennae and Support Structures) 'That the 100m rule in relation to Masts and residential areas,schools and hospitals be applicable to all Masts regardless of previous grants of permission whilst providing a three year period to all companies who currently have structures within the 100m zone to source alternative sites'.
2.5.8 Telecommunications
That in view of health and safety implications the plan excludes Tallaght Stadium and its immediate environs from any future telecommunications antennae and support structures.
Addendum to 2.5.6 Telecommunication Network - paragraph now to read (addendum in italics);
2.5.6 Telecommunication Network
The widespread availability of a high quality telecommunications network throughout the County will be critical to the development of a knowledge economy, will help attract inward investment in hi-tech knowledge based industries and will engender the image of the County as a premier location for enterprise. The provision of a high quality network is also desirable in terms of equality outcomes and the narrowing of the ‘digital divide.’ An accessible, high quality network will be of particular benefit to those who have not traditionally benefited from modern advances in telecommunications, in particular the elderly, those who are disabled and those from backgrounds of disadvantage. The advantages of a high quality telecommunications network must however be balanced against the need to safeguard the rural and urban environment, particularly in sensitive areas where the impacts on residential amenity and visual amenity of local areas needs to be adequately assessed. It is an objective of the Council to facilitate the roll-out of an effective 3G mobile broadband network in the County.
That on page 136 – 2.5.8 an additional point be added: “A statement from operators that the development will not impinge on access to the countryside including public rights of way and walking routes” and that the draft county development plan is amended accordingly.
That it is an objective of South Dublin County Council to prioritise the development of indigenous renewable energy resources within the County. In this context, it is an objective of the County Development Plan to support the continued investigation of the potential and scale of the deep geothermal heat resources within the County including those found at Newcastle. It is also an objective of the Council to support a pilot project to demonstrate the exploitation and use of the renewable energy resource in a new energy self-sufficient residential development and to ensure that such an energy resource is in use before this County Development Plan runs its course.
(This is to replace the final paragraph of 2.5.9 on Renewable Energy.)
That, as part of our County Development Plan, we develop clear, enforceable energy saving guidelines for new building construction in relation to public transport, solar power, insulation and the design of energy efficient homes, offices and industrial buildings.
2.5.9 (Renewable Energy) Amend Paragraph 4 to read: 'It is the Policy of the Council to support the exploitation of deep geothermal heat resources at Newcastle and the examination of the potential for further exploitation of this resource elswhere in the County in association with the development of new sustainable energy efficient Communities, in order to facilitate the development of future growth areas in the County in a sustainable manner'.
That this proposal for the following Specific Local Objective should be included in the Development Plan. The purpose of the objective is to provide concrete support for investment in the development of suitable renewable energy resources within this County within the plan period, in this case deep geothermal energy. The following specific local objective provides this support without a general land zoning for unsustainable speculative development.
Specific Local Objective
"It is an objective of the Council to prioritise the development of indigenous renewable energy resources within the County. In this context it is an objective of the County Development Plan to support the continued investigation of the potential and scale of the deep geothermal heat resources within the County, including confirmed available resources at Newcastle. It is also a specific local objective of the Council to support a pilot project to demonstrate the exploitation and use of the renewable energy resource in a new energy self-sufficient residential development adjacent to Newcastle. This will facilitate the development of future growth areas in the County in a sustainable manner. The specific local objective boundaries of the pilot project lands are outlined on the attached map. The development of the renewable energy pilot project lands shall be subject to the following provisions:
(a) No development whatsoever can take place within the specific local objective boundaries until the potential and capacity of the geothermal energy resource has been proven and demonstrated to the satisfaction of the Council.
(b) Development of the designated lands must not be undertaken in advance of the development of the geothermal resource. All development to be in accordance with the requirements and in a sequence to be agreed with the Council.
(c) Not more than 50% of the residential element of the designated lands to be developed in the lifetime of this Development Plan.
(d) Before the terms of this specific local objective can come into effect, every effort shall be made, to the satisfaction of the elected members of the Council, to locate the geothermal pilot project on the currently zoned residential land in Newcastle. However, if within 3 months from the date of adoption of this Development Plan, such lands cannot be made available or prove to be unsuitable, the pilot project shall be located on the designated lands as outlined on the attached map.
That on page 137 that a new policy “Policy EC 6: Hydro-Electricity” be added (with a consequent renumbering) and that the wording thereof should be taken from the Co Wicklow plan – 6.4.2 – page 76 and that the draft county development plan is amended accordingly.
That on page 137 – 2.5.11 – 3rd point that “and access to the countryside” be added and that the draft county development plan is amended accordingly.
Add an additional bullet point to Section 3.2.5, as follows:
- Facilitate and support the retention of existing jobs and the creation of new jobs in the County by assigning to the County Development Board responsibility to function as an Employment Task Force, as provided for in Government Guidelines issued to CEBs.
In Section 3.2.5 on page 147, add an additional bullet point as follows:
". Support County Dublin VEC in the provision of training and education programmes for adults to facilitate the enhancement of the knowledge and skills levels of people working and living in the County."
In Section 3.2.5 add an additional Policy, after PolicyEE2 on page 147, as follows:
It is the Council's policy to recommend to the County Development Board that it takes responsibility to function as an Employment Task Force, to support employment in the County, and to support the Board in carrying out such a role.
To amend the proposed new Enterprise Priority One Zoning Objective to read as follows: "To facilitate opportunities for intensive employment uses complimented by mixed-use development based on the creation of sustainable urban communities with high-quality public transport linkages, and in accordance with approved Local Area Plans”.
That it is the policy of South Dublin County Council to again negotiate with the Department of Defence with the aim of reducing the no development restriction area at Baldonnell Airport to that of norm at international airports generally, thus allowing some currently zoned lands to be opened up for use.
That the Manager outlines a plan for Casement Aerodrome, Baldonnel.
That on page 154 - 3.2.14 the following paragraph should be added: “An important element of tourism is the availability of and the protection afforded to the county’s natural amenities, built and natural heritage and availability of country recreation as set out in Theme 4 – Sections 2 & 3 and many of the Specific Local Objectives on pages 222 to 226.” And that the draft county development is amended accordingly.
That on page 154 – 3.2.15 an additional policy entitled “Rural Tourism” be added: “It is the policy of the Council to encourage farmhouse accommodation, open farms and agri-, green-, eco- and geo-tourism” and that the draft county development is amended accordingly.
That on page 154 – 3.2.16 the section be re-entitled: “Rural Land-use” and that the following be added as the 1st paragraph: "The Council will consider land-use and agriculture in a new light since the introduction of the Single Payments Scheme which is leading to a fundamental shift in farming practice. In the coming years a new perspective on rural land-use will be required, which up to now has been as seen primarily agricultural. Now under the SPS regime land, especially commonage and other rough grazing land, should be regarded primarily as an environmental/recreational activity. Farmers will be encouraged to see themselves as custodians of the countryside. The requirement to farm environmentally as a condition of payment of subsidies should be extended to include the provision of reasonable access to the countryside.” And that the draft county development plan is amended accordingly.
That the following amendment be included in the written statement:-
3.2.15.v Policy EE28: Tourist Trails
It is the policy of the Council to implement a tourist trail of the villages of Clondalkin, Lucan, Newcastle-Lyons, Rathcoole, Saggart, Brittas and Tallaght.
ADD RATHFARNHAM.
That on page 155 – Policy 3.2.17 an additional policy be added entitled “Fencing” with the wording taken from the Mayo development plan – 4.22 and that the county development plan is amended accordingly.
That on page 156 – 3.2.18 – the following be added to Policy EE35 :”and the impact on access to the countryside including public rights of way and walking routes” and that the draft county plan is amended accordingly.
That office accommodation be permitted within all Zone E objectives.
That the Plan will encourage and facilitate steps or measures to enhance the revitalisation and long term viability of Tallaght Village and end the proliferation of take away units.
That the Plan will encourage and facilitate steps or measures to enhance the revitalisation and long term viability of Tallaght Village and end the proliferation of empty apartments in the immediate area.
That the Plan will encourage and facilitate steps or measures to enhance the revitalisation and long term viability and concept of a living Village in Tallaght and attempt to eradicate empty and derelict sites in the immediate area.
To add a new policy objective after section 3.3.14 as follows: “It is the policy of the council to conduct regular joint reviews of the development of both Clonburris and Adamstown so as to identify opportunities for coordination between both developments and to respond jointly to changing market conditions and if necessary to amend the relevant SDZ planning schemes and Local Area Plan accordingly."
Under Town District and Local Centres - Section 3 - ref. 3.3.18 - proposed to add: "It is also the policy of this Council to prevent the loss of distinctive features in Lucan Village. Lucan village remains a village of immense beauty, conservation, heritage, and architectural value, historical significance and has enormous future tourist potential. Development will only be allowed if it conserves or enhances the varied character of Lucan village."
That the following amendment be included in the written statement:-
3.3.20 Rathfarnham Village
Add - the link to Rathfarnham Castle and the village needs to be strengthened.
National heritage area designations in Brittas, Rathcoole, Saggart de-zone any land the Council owns in these areas that the areas in question undergo local heritage area plans to decrease development here. that it be a stipulation in the plan to increase heritage areas in these areas where possible. i.e. any land that the council has that is zoned residential, a % set aside
To add a new policy objective to section 3.3.36 as follows: "It is the policy of the council to support the preparation and implementation of urban design masterplans for existing local centres so as to facilitate the regeneration and improvement of these centres as key commercial, civic and social hubs for the local community, with a strong sense of place and with improved linkage to surrounding residential areas."
To amend Policy S3: Scale and Location of Retail Development to add the following additional sentence at the end: “All planning applications seeking provision of additional retail floorspace will be strictly assessed to ensure that additional traffic generated by the scale of the proposed development will not lead to traffic congestion."
That the Plan encourages and agrees to facilitate the enhancement of shopping and other services in the Square and its surrounds with a view to sustaining the long term viability of jobs in the area.
Amendment to 3.4.10.vii Policy S7: Local Centres
Third paragraph;
Remove "should" and replace with "may" - full paragraph as amended will read;
"Proposals to upgrade existing district or local centres may include a residential element, as a method to revitalise the area and provide for 24 hour surveillance, thus enhancing the security components or residential amenity in the vicinity after trading hours."
That the following amendment be included in the written statement:-
3.4 ADD A SECTION ON FAST FOOD TAKE AWAYS – with the following criteria
In all applications for fast food take away there will be a need to balance the needs of local residents with the need to create a mixed-use vibrant community. In order to maintain an appropriate mix of uses and protect night time amenities in a particular area.
A prohibition on new betting shops within 100m of any school boundary.
That the decision of granting permission for off licences be given to a vote by the Councillors.
That this Council develops a framework to develop interactive digital media (e.g. at luas stops) as opposed to paper based or digital advertising.
That the following amendment be included in the written statement:-
3.4.18.iv Policy S35: Signs on Shopfronts and Other Business Premises
ADD – the use of the Irish language is encouraged.
That this Council take into account when planning applications are received on lands of the curtilage and attendant ground of Protected Structures in this County that regard to:
- The setting in its garden or parkland in that its setting in its environment should be preserved as much as the protected structure itself.
- The setting of the Protected Structure with regard to its local environment i.e. wild life, flora and fauna.
- The historical significance of its surrounding to the Protected Structure and to its local community.
That the following amendment be included in the written statement:-
4.2.7.vi Policy AA6: Areas of Archaeological Potential
include Rathfarnham as an Area of Archaeological Potential as Rathfarnham has already been designated an Architectural Conservation Area (ACA).
Archaeological, Heritage and Conservation - ref. The Protected Place - Theme 4 - to propose to ad 4.2.9.vi - "It is the policy of the Council to provide appropriate signage in areas, sites, villages, buildings of Archaeological, Heritage, Conservation and Historical significance."
That on page 201 – 4.2.7 – Policy AA1(b) on 4th line after “and” substitute for the remainder of the sentence: “the provision of public access to archaeological sites, and National Monuments in state care, council or private ownership and all traditional access routes will be designated as public rights of way. In other cases the Council will acquire the routes either by agreement with the landowners or by way of compulsory powers. Appropriate signage will be put in place.” and that the Draft County Development Plan is amended accordingly.
NB Should the above motion not be accepted, 8.3.4.iv – page 132 of the 2004 Plan should be reinstated.
Under Landscapes, Natural Heritage and Amenities, Section 3, ref. 4.3.4 Landscape - proposed end of paragraph 4 to read "and the Liffey Valley."
That, with reference to 4.3.5.ii Policy LHA2, a number of locations in and around Lucan village, including the top of the open space beside Brookvale Estate, Old Dublin Road, overlooking Lucan Village and the Liffey Valley, be examined for inclusion in the list of Viewing Points and Prospects in Table 4.3.1, on page 207.
Modify Table 4.3.1 in Section 4 to include three new Prospects for which it is an objective to protect. This is the view from the N4 across the Liffey Valley and ties in with the policy expressed in section 4.3.7.

Under Archaeological and Agricultural - Section 2 - ref. 4.3.7.i - proposed to add the following sentence "The council also recognises and will promote the Liffey Valley as having major tourist attraction potential."
It shall be an objective of the new County Development Plan that SDCC shall, within one year of the adoption of the plan, take the initiative in inviting Fingal, Dublin City and Kildare Councils to work collaboratively and positively for the development of a Liffey Valley Park within the boundaries described by the Liffey Valley Park Alliance and as proposed in the OPW ‘Towards a Liffey Valley Park’ report of 2008 and shall bring forward firm proposals for to the elected members within a further period of one year.
That section 4.3.7.iii of the Managers Draft Plan be amended to include a full stop after “Public Ownership” The new paragraph to read “It is the policy of the Council to promote and develop a Liffey Valley Park in line with the policies and objectives of the OPW Report ‘Towards a Liffey Valley Park’ (2008)
It shall be a policy of the new County Development Plan to actively promote and secure existing and additional right-of-ways along the Liffey Valley from the City boundary to the Kildare border to facilitate walkers and to provide access for members of the public to this natural amenity in a sensitive and sustainable manner.
It shall be a policy of the new County Development Plan that Council management must, within six weeks of any approach, bring to the members a full report giving full details of any approach from land owners, developers or speculators to any proposal to provide housing, building of any type, to develop or to alter existing the built or natural environment in any way, whether permitted or open to consideration, that impinges in any way on the Liffey Valley.
Reference - Liffey Valley - to propose: "It is the policy of the Council to prioritise the protection of the landscape within the Liffey Valley."
Reference - the Liffey Valley - to propose: "It is the policy of the Council to pursue the expansion of the existing Special Amenity Area Order in keeping with the expressed wishes of its members in the Council 2004-2010."

Reference - Liffey Valley - to propose: "It is the policy of the Council that a Special Area of Landscape Character Area be designated to the Liffey Valley."
Reference - the Liffey Valley - to propose: "It is the policy of the Council to define the area of the Liffey Valley as envisaged by the Liffey Valley Alliance, and to include lands in private ownership as well as lands in public ownership."
To facilitate clarity on the status of the lands in the Liffey Valley, the Manager is to provide to the Councillors details of the different zoning types and identification of the associated parcels of lands for each zoning type involved to cover the following area:
All the lands included in length within the Council’s jurisdiction stretching from Palmerston to the county boundary, and in width from the County’s northern boundary with the River southwards to the N4, until it intersects with the Celbridge Road, and thereafter using the Celbridge Road as the southern boundary for the study, and to include all the lands of Lucan Golf Course, Cooldrinagh and Tubbermaclugg.
These details to be provided in a map and associated list, and to include ownership details if possible. These details to be provided by Oct 2009.
That on page 209 – Policy LHA8 – 5th line – “will seek to “ be replaced by “protect” and that the Draft County Development Plan is amended accordingly.
That on page 210 – Policy LHA 14 be relocated in Theme 3 – Section 2 and that the following new policies be added:
"1 It is the policy of the Council to facilitate access to forestry, including private forestry, for walking routes, mountain bike trails, bridle paths and other non-noise generating activities.
2 Forestry should not obstruct existing rights of way or traditional walking routes.
3 It is the policy of the Council to identify existing rights of way and established walking routes before planting commences.
4 It is the policy of the Council to protect access routes to upland walks and rights of way"
and that the Draft County Development Plan be amended accordingly.
That on page 210 – final paragraph the 1st line be deleted and that the Draft County Development Plan be amended accordingly.
Policy LHA 15 Trees and Woodlands/Table 4.3.4 Tree Preservation Orders
That a survey of significant groups of trees in the Lucan area, including the trees along the Old Lucan Road, at the rere of Esker Lawns estate, be carried out with a view to including some of them in the list of Tree Preservation Orders.
4.3.4. Tree preservation orders: "That a tree preservation order be placed on the many century old trees in the vicinty of Kiltalown House and Kiltalown Park Jobstown".
4.3.4 Tree Preservation orders: "That a study be carried out on the many Century old trees in the grounds of Peamount Hospital Newcastle, with a view to a tree preservation order being placed on them before the completion of the consultation stage of the plan".

That on page 212 – Policy LHA18 – last paragraph – 1st point “15” be substituted for “10” and that the Draft County Development Plan be amended accordingly.
That on page 213 – Policy LHA23 a new paragraph be added: “The Council will investigate the feasibility of adopting a joint management structure with Dublin City Council for the Bohernabreena Reservoirs, and will report back within two years of the adoption of the Development Plan” and that the Draft County Development Plan be amended accordingly.
That on page 213 – Policy LHA21 “and to encourage and promote access thereto” be added and that the Draft County Development Plan be amended accordingly.
That on page 214 – 4.3.9 – Policies LHA23, LHA26. LHA27 & LHA 32 “within two years of the adoption of the Development Plan” be added and that the Draft Development Plan be amended accordingly.
That on page 214 – Policy LHA25 the 1st paragraph be deleted and that the Draft County Development Plan be amended accordingly.
That on page 214 – 4.3.8 a new policy be included: “Golf Courses – It is the policy of the Council to ensure that proposals for golf courses or any extensions to existing ones will not impinge on any public right of way or walking route” and that the Draft County Development Plan be amended accordingly.
That on page 215 – Policy LHA27 - 2nd paragraph “non-noise generating activities” be added after “other” on 6th line and that the Draft County Development Plan be amended accordingly.
That the following amendment be included in the written statement:-
4.3.9.xi Policy LHA32: Public Rights of Way
It is the policy of the Council to preserve and/or extend and enhance existing public rights of way and to create new rights of way in the interest of amenity as opportunities or needs arise
Add – allowing for extinguishment of certain urban public rights of way as provided for in Roads legislation.
That on page 215 – Policy LHA32 all except the 2nd paragraph be deleted and replaced by:
1 - “List existing public rights of way, within one year of the adoption of the plan, but if the examination of traditional walking routes for possible designation is not completed within this time, that an Interim List will be prepared. The list will be accompanied by detailed maps showing the actual routes and the appropriate signage will be put in place. The list will be included in the Plan by way of Variation.”
2 - “Protect, preserve, promote, enhance, improve and maintain, for the common good, existing rights of way.”
3 - “Create new rights of way, as required, or extend existing rights of way either by agreement by or by way of compulsory powers in the interest of ensuring access to amenities. In particular, rights of way should be provided to from built-up areas to the countryside”.
4 – “Prohibit development and keep free from obstruction existing rights of way and walking routes, and take legal action if necessary to prevent any attempt to close them off."
5 – “Prohibit development which would prejudice public access to existing rights of way, unless specific arrangements are made for suitable alternative linkages.”
6 – “Look favourably upon planning applications which include proposals to improve the condition and appearance of existing rights of way.”
7 – “ Developments will not be permitted where a public way will be affected unless the level of amenity is minimised by:
(i) The footpath/bridleway being diverted by the minimum practical distance and the route continuing to be segregated from vehicular traffic;
(ii) Appropriate legal procedures have been undertaken to extinguish the existing right of way and to establish the new right of way to replace it.”
8 - “Existing rights of way and established walking routes shall be established prior to any new planting, new infrastructural development and any new energy/telecommunication developments.
That on page 216 – Policy LHA33 “with appropriate signage” be added to the 1st paragraph and in the penultimate paragraph “Keep Ireland Open” be added after “Partnership” on 6th line and that the Draft County Development Plan be amended accordingly.
To replace Local Zoning Objective 1 relating to re-development of Co-op Site at Cooldrinagh with a Specific Local Objective to facilitate removal of derelict buildings from this site.
Under Local Zoning Objectives, 1, Cooldrinagh - Redevelopment of former Co-Op Site, to propose adding the following final sentence "Any development will be confined to the footprint of the old buildings and be of a scale suitable to a green belt, adjacent to the Liffey Valley."
Under Local Zoning Objectives - Cooldrinagh - proposed to include: "2. It is the policy of the Council to consider proposals for the development of this area, including the recent proposal for the creation of a public park and recreational facility at Cooldrinagh, Lucan, made by Lucan Planning Council."
That Specific Local Objective 5, Lucan-Church of Ireland School be amended to read as follows:
"Facilitate the expansion of the Church of Ireland school in Lucan, on a site of appropriate area in a location to meet the particular needs of the school community."
That a new Specific Local Objective be added as follows:
Griffeen Valley Park
To continue to improve Griffeen Valley Park and to increase its biodiversity through appropriate measures including the provision of lakes and water features.
Add an additional Specific Local Objective as follows:
Old and new Cemetery Lucan
Enhance both cemeteries by undertaking and implementing a landscape assessment and plan
Add an additional Specific Local Objective as follows:
Take-in-charge the Brookvale Estate Open Space and develop the area at the top of Esker Hill as a Viewing Location for views over Lucan Village and the Liffey Valley.

Enhance and promote the small area of parkland/woodland along the Newcastle Road on the Lucan village side of Vesey Park and the Moat House area.
Add an additional Specific Local Objective as follows:
Encourage and facilitate the sensitive and selective lighting of key buildings and structures in Lucan Village such as Churches and the Liffey Bridge.
To add a specific local objective to provide for a time-related HGV ban along Newcastle Road from the N4 to the Grand Canal.
To add the following proposed local zoning objective for the vacant site next to Lucan Educate Together School, Mount Bellew Way: “Facilitate provision of car-parking and drop-off facilities and other community or education uses for the use of Lucan Educate School following consultation with the school authorities and subject to the agreement of members of the council."
To add a specific local objective to the lands currently used for the Esker Green Waste Centre reserving these lands for the current use as a Green Recycling Centre and Local Authority depot and requiring that development of any other proposed use can only proceed following preparation of an approved plan agreed by the elected members following appropriate public consultation.
To add a specific local objective to seek removal of the pylon next to the Sentinel Building in Adamstown.
To add a specific local objective to provide for the permanent closure and secure fencing-off of the Old Lucan-Newlands Road embankment between Moy Glas & Castle Riada estates.
To add a Specific Local Objective to provide for additional car-parking and traffic management measures to improve traffic flow in the vicinity of Scoil Mhuire, Airlie Heights.
To add a specific local objective to redevelop lands at the Bush Centre & Parochial House at Foxdene in partnership with the Parish of South Lucan, to include delivery of a new community centre for the Balgaddy/South Lucan area.
To add a Specific Local Objective to provide for a site for permanent school accommodation for Esker Educate Together NS.
To add a specific local objective facilitating provision of a new Educate Together second-level school for Lucan.
To replace Specific Local Objective 9 regarding “Palmerstown- Planning Study” with the following specific local objective to ‘prepare a Local Area Plan for Palmerstown to provide a coordinated framework for the regeneration and future development of the city suburb to include:
- Strategies for facilitating the development of vacant or underutilised infill sites;
- A integrated traffic & mobility strategy for the entire of Palmerstown;
- Detailed proposals for the provision of additional community facilities including a library and digital hub;
- Strategies aimed at improving both the urban and natural environment.'
Specific Local Objectives - To propose to included 13.1 - "It is the policy of the Council to pursue as a matter of priority with the National Roads Authority, the provision of an up-graded junction, including an underpass on the N4 at the Kennelsfort Road junction, similar to the successful underpass on the N4 at the Newcastle Road junction in the interest of accommodating local traffic between Palmerstown village and the greater Palmerstown residential areas."
It shall be a Specific Local Objective of the new County Development Plan that direct access for motorised traffic be provided for the Liffey Valley Town Centre from the N4 and that this be achieved if necessary by re-designing the existing Fonthill/N4 junction and that funding for this necessary infrastructure be reflected in levies imposed on any development in the Liffey Valley Town Centre and additional funding be actively sought by Council Management from the NRA.
It shall be a Specific Local Objective of the new County Development Plan that Palmerstown Village be the subject of a Local Area Plan that takes full account of the historical and heritage significance of this Village and that Palmerstown Village be given its rightful status through suitable inclusion in section 3.3. of the Manager's Draft Plan.
Specific Local Objectives - To propose to be included 13.1 - "It is the policy of the Council to pursue as a matter of priority with the National Roads Authority, the provision of an up-graded junction, including an underpass on the N4 at the Kennelsfort Road junction, similar to the successful underpass on the N4 at the Newcastle Road junction in the interest of accommodating local traffic between Palmerstown village and the greater Palmerstown residential areas."
That this Council agrees to submit the following addendum to SLO 12 after the final sentence:
"And that the North Clondalkin Library be located in North Clondalkin rather than in the Liffey Valley Shopping Centre."
That the Council develops the area at Monastery/Lexington by supporting the development of allotments/plots.
That this Council works with the Monastery Residents Association in developing allotments there working with South Dublin County Allotments Association.
That this Council allocates the funding required for the Round Tower, Clondalkin. A percentage of funds from rates/zonings etc (e.g. from Milltown) could be used to generate funds.
That this Council installs a GAA pitch on the Grange Lands adjacent to Kilcarbery in conjunction with the residents association and Clondalkin GAA.
That funding (again from capital percentages) be allocated to develop St Cuthbert's Community Centre, again saving money in the long term.
That the Manager removes from the development plan connection to the M50 from Cloverhill Road, Clondalkin.
It is the policy of this Council to promote Corkagh Park as a sporting centre of excellence for the County to further compliment its existing facilities such as the sports and leisure centre, swimming pool, all weather pitches, tennis courts, grass pitches, fishing lakes, baseball ground, etc.
This Council agrees to change the wording of SLO 47 to the following:
"To facilitate the development of Peamount as a centre of excellence in the provision of a range of high quality rehabilitation and continuing care services. To facilitate the development of a state of the art Continuing Care Facility and Rehabilitation Unit and associated ancillary facilities to serve the expanding population of its catchment area."
S.L.O.47 Peamount Hospital. Amend entire wording to read: 'To facilitate the development of Peamount as a centre of excellence in the provision of a range of high quality rehabilitation and continuing care services. To facilitate the development of a state of the art continuing care facility and rehabilitation unit and associated ancillary facilities to serve the ever expanding population of it's catchment area. To facilitate further the retention of the existing TB and Chest units".
To amend the local objective entitled Enterprise lands – Framework Plan (unnumbered, top of page 244 of the Draft Written Statement) to add an additional objective as follows: “prior to the commencement of development, traffic arrangements shall be put in place to ensure that the use of the R120 (Grange Castle to N4) by HGV traffic to and from developments on these lands would be prohibited."
That it is agreed to add the following words to the SLO on the N7/ Tay Lane Junction ( p. 225):
After the words Tay Lane on Line 2 'and to maintain the exit from Tay Lane'.

S.L.O.115 Oldcourt - Conditions on Development. Amend to include a further condition: "(e) That all appropriate road upgrading and improvements in relation to capacity and safety be completed prior to any further development of the area".
S.L.O. Firhouse - Former Carmelite Convent. Amend to to insert after the proposed wording 'and make provision for the development of a regional sized playgound to service the Communities of Firhouse, Ballycullen and Knocklyon".
That the Plan agrees to promote, encourage and facilitate pedestrians from Greenpark and Greenhills attempting to traverse the road and use bus services on the Greenhills Road by the introduction of a safe route across this busy thoroughfare.

That the Plan in relation to Balrothery Estate Residential Development takes cognisance of the fact that residents have voluntarily maintained the upkeep of many lands in the area, that the residential amenities be protected and enhanced and agrees involve local residents in any future housing proposals for the immediate area.
That the Plan agrees to implement a plan to enhance the security and long term safety of residents in Kilmartin Tallaght that have had to endure problems following erection of an outer wall along their properties and the Outer Ring road.

To add the Marian Grotto at Dodsboro Road, Lucan to the Record of Protected Structures in recognition of it’s important cultural significance to the local community.

To amend Schedule 3 to clarify that the “Shop-Major Sales Outlet” building class relates to units in excess of 1000sq.m net public floor area.
Under Weston Aerodrome, Schedule 5 - Proposed to include"That this Council acknowledges An Bord Pleanala's Decision of December 2003, when considering future planning applications in the context of intensification of use of Weston Aerodrome."
That this Council will encourage and facilitate the occupants of social and affordable housing to upsize/downsize their property according to their changing needs.
That this Council, when possible, will fully integrate social, affordable and private housing in order that no apparent distinction can be made.
Housing Strategy: "That an 'overnight' homeless unit be either built or acquired within the County for the Homeless people of the County and that this be fully resourced and operational within the lifetime of the plan. This policy to be pursued in consultation with relevant bodies such as Focus Ireland, Tallaght Homeless Advice, etc."
Under Landscape Character Area Description, 1 Liffey Valley, Landcover, Strategy, to include "It is the policy of the Council to provide Park Warden Service for the Lucan Demesne."
That on page 315 – Regional Plans and Strategies - the following be added:

Landscape Character Area Description
11. Firhouse /add Rathfarnham
To introduce a new zoning objective LV “To protect and enhance the outstanding natural character of the Liffey Valley”; and to re-designate all lands north of the N4 currently zoned G (high amenity) or GB (green belt) under this new LV zoning; and to further amend both policy LHA4 and specific local objective 3 to seek that the proposed extension of the Liffey Valley Special Amenity Area Order would include all lands zoned LV.
The Management shall explore and insert in the next draft of the County Development Plan before it goes on public display, a Zoning category similar to that which applies to the Dublin Mountains for the area of the Liffey Valley that lies within South Dublin County, that includes all (but not only) the SAAO and that is bounded by the river Liffey on the one side from Chapelizod to Leixlip, and the Old Lucan Road from the City boundary to the M50 and by the N4 as far as the junction with the Outer Ring Road, from there by the Old Lucan Road again to Lucan Bridge, that includes all of Lucan Demesne, Lucan Golf Course, Cooldrinagh (including Weston Airport) and Tobbermaclog, with the objective of distinguishing the unique landscape which is the Liffey Valley from other Green Belts and providing the Liffey Valley with the maximum protection for future generations.
Given the proximity of the Lucan Golf Club lands to the river Liffey and it’s current green undeveloped status; and the fact it forms and is seen as part of the green belt between the residential communities of Lucan and Celbridge; together with the enormous extent of land already zoned in the county and the decrease in demand for development – this proposal warrants no further consideration. In summary given the above and also but not limited to the criterion of ‘Policy Context’, ‘Environmental & Heritage’, ‘Environment’ and ‘Assessment of Need’, it should be rejected and not carried into the Draft Plan for further consideration.
That the strip of land along the railway line immediately south of Griffeen Valley Park reverts to its current Objective F (open space) zoning instead of the Objective A zoning shown on the draft maps.
That the enclosed site adjacent to 58 St. Patrick's Park, Clondalkin be zoned residential to allow for the building of 1 dwelling to stop the ongoing anti social activities and the unkempt condition of the site given the quiet and well maintained remainder of the estate. The Local Authority is already aware of the history of this site.
That this Council recommends that the small open space at the end of cul de sac at Willbrook Lawn, Rathfarnham i.e. ALL green space adjacent to no. 29 and no 30 Willbrook Lawn – now in dispute with legal department SDCC re no. 30 – that all of this area be rezoned F open space to ensure it is maintained as open space as provided for when the Willbrook Lawn area was developed.
Map of full area available in parks department if required or on mins of TRAC meeting on this subject.
That this Council recommends that the piece of land at Stonepark Estate marked (a), (b), (c), (d) on the attached map designated open space but currently zoned A on the development plan map be rezoned to F open space. (map outlined in red)
That this Council recommends that the piece of land at Coolamber Park - rear of cottage No 7 (open space on Knocklyon Road) No. 2 on attached Map C designed open space but currently zoned A on Development Plan Map be rezoned to F open space.
That this Council recommends that the piece of land at the rear of Idrone Close (known locally as Black Path) as indicated on attached Map C No. 1 designated open space but currently rezoned to F open space. (map outlined in red included).
That this Council recommends that the piece of land in Coolamber Park beside Cremorne outlined as 2B on attached map C designed open space but currently zoned A on Development Plan Map be rezoned to F open space.
That this Council recommends that the piece of open space land at Templeroan Green (at roundabout) as indicated on enclosed map No 3 designated open space but currently zoned on A on development plan map be rezoned to F open space.

That this Council recommends that the piece of open space land at Orlagh Grove as indicated on enclosed map No 7 designated open space but currently zoned on A on development plan map be rezoned to F open space.
That this Council recommends that the piece of land at Castlefield Orchard No. 12 on enclosed Map E designated open space but currently zoned on A on development plan map be rezoned to F open space.
That this Council recommends that the piece of land at Castlefield Manor No 11 on enclosed Map E designated open space but currently zoned A on development plan map be rezoned to F open space.
That this Council recommends that the piece of land at Cremorne Estate Junction with Firhouse Road, No 14 on attached map designated open space but currently zoned A on development plan map be rezoned to F open space.
That this Council recommends that the piece of land at Ballyroan Road - strip of green open space leading to Ballyroan Crescent, No. 5 on enclosed Map B designated open space but currently zoned A on development plan map be rezoned to F open space.
That this Council recommends that the piece of open space land at Marian Road and junction of Ballyroan Road at No. 6 on enclosed Map B designated open space but currently zoned A on development plan map be rezoned to F open space.
That this Council recommends that the piece of land at the junction of Silverwood Road/Marian Crescent No. 15 on Map G (attached) designated open space but currently zoned A on development plan map be rezoned to F open space.
That this Council recommends that the piece of land at Glenvara Park No. 8 on attached map D designated open space but currently zoned A on development plan map be rezoned to F open space.
That this Council re-zones land currently zoned as objective A1 in the immediate vicinity of the McUlliam Estate to objective F in keeping with the proper planning and sustainable development of this area given the enormous and ongoing difficulties experienced by the local community due to lack of open space in the area.
That this council reverts to objective F land that is currently zoned objective A in the vicinity of the Tallaght Leisure Centre at Jobstown Park. This land was the subject of a variation to the previous Development Plan - in keeping with the proper planning and sustainable development of the area.
That this Council zones land in the vicinity of Citywise/An Turas/JADD/Jobstown Community Centre in an appropriate way to ensure that the land is used in a way to benefit the community in terms of amenities as opposed to further residential development.
That this Council ensures zoning of land in the vicinity of St Maelruan's School Jobstown is suitable to the environs of this school.
That this Council ensures that intended objectives to provide school sites in the Citywest area are clearly outlined on the Development Plan maps eg. there is currently still an objective for a Primary School marked on map 4 on the site for the Citywest District Centre - this site should have been outlined on the map in the vicinity of Magna Business Park just off the N82.
That this Council change the planning designation from A to F of open green spaces in residential areas witch are currently used as open green areas in areas that have been developed in the County.
That this Council agree to set up a dedicated anti-social task force with powers to deal with the ever increasing attacks upon our tenants and our property which demeans and destroys communities at a great social and financial cost to this County.
That in view of the confusion and uncertainty regarding NAMA that will effect major aspects of this Development Plan for South Dublin County Council that the Plan will encourage and take cognisance of the Nama Strategy including the probable sell off of sites and properties and agrees that the Council carry out an immediate assessment of the scale of and the possible exposure this will have within the Council area.
That in view of the visual and negative impact of large scale building on residents living in the Springfield area of Tallaght that the plan will promote and encourage enhanced environmental provisions be implemented during the lifetime of the plan for residents living in the shadow of many of these buildings.
That the Plan will encourage and facilitate additional and enhanced security of tenants living in the Kilmartin area of Tallaght by addressing the immediate removal of large mounds of soil left over from Luas works.
That the Plan in view of the ongoing concerns regarding dust levels in the Fettercairn and Brookview areas agrees to facilitate regular testing on the potential hazardous dust levels and their potential health implications on residents.
That the Plan acknowledges and agrees to urgently implement a window installation programme fro residents living in Council housing in Rossfield Estate
That the public consultation be re-examined to give a fair weight to the number of submissions made on specific areas of interest.
That any land the Council has that is zoned housing, be zoned open recreation. We cannot de-zone private investors' land and there is excessive land zoned in the county.
That the Council gives a list of sites it owns for residential development throughout the county that have NOT YET been developed. and that a % be de-zoned to recreational amenity
