MOTION NO. 207

MOTION: Councillor G. O'Connell

It shall be a policy of the new County Development Plan to actively promote and secure existing and additional right-of-ways along the Liffey Valley from the City boundary to the Kildare border to facilitate walkers and to provide access for members of the public to this natural amenity in a sensitive and sustainable manner.

REPORT:

It is the policy of the Council to preserve and enhance existing public rights of way and the creation of new ones in the interests of ensuring access to amenities for recreation and amenity purposes (LHA 32). It is also the policy of the Council to promote the development of regional and local networks of hiking and walking routes (LHA 33).

It is considered that Policy LHA32 Public Rights of Way  adequately addresses the issues arising having regard to the significant legal complexities surrounding the issue of  public rights of way. It should be noted that the measures proposed would require the allocation of substantial resources having regard to the legal requirements to be satisfied for the purpose of registering such easements without giving rise to costly legal challenges by affected landowners.  

It is considered that the above policies in the Draft County Development Plan actively promote and secures existing and additional rights of way in the County.

No change to the Draft Development Plan required.
