MOTION: Councillor P. Cosgrave
That this Council take into account when planning applications are received on lands of the curtilage and attendant ground of Protected Structures in this County that regard to:

Part IV of the Planning and Development Act 2000 deals with Architectural Heritage. Sections 51-80 deal with Protected Structures. In particular development plans must include objectives for the protection of such structures to ensure proper planning and sustainable development. Where a structure is protected, the protection includes the structure, its interior and the land within its curtilage and other structures within that curtilage (including their interiors) and all fixtures and features which form part of the interior or exterior of these structures. All works which would materially affect the character of a protected structure, or a proposed protected structure will require planning permission. The Planning and Development Act 2000 requires that a protected structure be of special interest under one or more of the following categories;
The ‘Architectural Heritage, Guidelines for Planning Authorities’, 2004 provides specific guidance to aid in the development management process and in assessing planning applications for protected structures.
In the assessment of all planning applications the Council must adhere to the Planning and Development Acts 2000-2007 and have regard to relevant Guidelines. The Draft Development Plan reflects this accordingly.

No change to the Draft Development Plan required.
