MOTION NO. 189

MOTION: Councillor C. Brophy

A prohibition on new betting shops within 100m of any school boundary.

REPORT:

The effect of the motion is to pre-judge planning applications which is not permissible in Irish Planning Law.

The Draft Development Plan policies Section 3.4.10.viii, Policy S8 and Section 3.4.11 and Policy S15 ensures that the assessment of planning applications for this type of development will pay particular attention to the possible effects on adjoining property and will be strictly controlled having regard to the effect of noise, general disturbance, hours of operation, litter and fumes on the amenities of nearby residents or adjoining commercial activities.

This is considered to be sufficent and appropriate to permit the Planning Authority to make determinations on such planning applications in a fair and equitable manner.

MANAGER’S RECOMMENDATION:

It is recommended that this Motion not be adopted.
