Planning
Questions
To ask the Manager for a further update, including a likely timeframe, for completion of the taking-in-charge of Larkfield and Mount Bellew Estates in Lucan, both of which were developed by Fitzgibbons Bros?
To ask the Manager if he will make a report on any representations received from individual residents in Rosse Court, Lucan, and or the Management Company for the development, regarding incidents of anti-social behaviour, if the Council has had any discussions with An Garda Síochana or the Developer, and if he will make a statement on the matter.
To ask the Manager if there has been any discussions between the Planning Department and the owners of the Liffey Valley Town Centre, who made the Planning Application recently rejected by An Bord Pleanala, and if he will make a statement on the matter?

That the Manager bring forward a report detailing how the bond for the Riversdale Estate was dealt with (Item ID 24704 at the September meeting), and in particular to explain what, if any amount, was retained in lieu of the failure of the developer to deliver on Condition No. 9 of the Grant of Planning Permission which stated inter alia:
‘The walls at the rear of the proposed houses numbers 2 to 24 and along the western boundary of the site shall be retained at their existing heights and shall, prior to the construction of any of the houses hereby permitted, be repaired, made good and improved, where necessary, with walling that matches the said walls…..’ and to explain why the Council did not use the bond to address the situation.
Furthermore, this Committee notes that the wall in question was not erected as a boundary wall for the houses that back onto it (as is implied in the Report presented at the September meeting) but is rather a heritage wall that bounds the park and which An Bord Pleanála stipulated had to be preserved. The wall in question is at least as much the responsibility of the County Council as the owners of Waterstown Park as it is of the neighbouring residential properties. Both parties were entitled to have it properly maintained as per the planning condition prior to or at the same time as both the Estate and the Park were taken in charge/into Council ownership.
This Committee recommends that the matter be referred the next full Council meeting with the objective of having the Council carry out without delay the necessary works to the wall that should have been done as set out by An Bord Pleanála on Condition 9 and at no expense to the residents concerned.
That this Committee requests the Manager to agree to take in charge the open space as part of Mount Andrew Court and Mount Andrew Rise, and that the Manager would agree to initiate the necessary procedures under Section 180 of the Planning and Development Act 2000 for the taking in charge of this land in keeping with my previous representations on behalf of local residents in Mt. Andrew Court and Mt. Andrew Rise, and that if agreed by the elected members the Manager would then agree to meet the residents of Mt. Andrew Court and Mt. Andrew Rise again as part of this process.
That this Area Committee, further to the report presented to the November meeting of the council's OP&F Committee on future projects stemming from Development Plan objectives, requests the Manager to present a detailed report on future forward-planning projects for the Lucan electoral area as either identified in the new Development Plan or otherwise considered necessary or appropriate by the Manager, and that this report would form the basis for discussion with the elected members on the selection of priority projects in the Lucan electoral area to be progressed over the coming year. In particular the Manager is requested to report on the resources likely to be required to progress the following three specific projects which may be considered as priorities by the elected members:
-
Review of the Liffey Valley Town Centre LAP- on foot of the two recent planning refusals by an Bord Pleanála;
-
Review of Adamstown SDZ planning scheme - taking account of changed market conditions and radically-altered development potential; and to provide an opportunity for existing residents of the SDZ to input on the future development of THEIR community;
-
12th Lock Masterplan -in conjunction with interested landowners.
Development
Questions
To ask the Manager if he will provide a report on the Council's Allotments in Palmerstown, the report to include information the number of allotments, the total rental income received from plot holders in 2010, and the number of allotment holders who were eligible for the reduced rental rate in 2010?
To ask the Manager if he will consider, and investigate, the possibility of the Council renting land from the owners of the Clonburris and Adamstown SDZ, in view of the probability that substantial proportions of these lands are likely to remain undeveloped during the next 5 years, for the purpose of providing allotments, under short lease terms, to persons from Lucan and Palmerstown on the Council's waiting list for allotments?

That this Committee, given the impact of the four year National Plan on the citizens of this County, calls on Council Management not to implement the proposed 2011 increase in the rent for Allotments in the Lucan EA and that a more modest increase, reflective of the fact that this is basically a social service and not a commercial venture, be prepared for inclusion in the forthcoming Budget.
Parks
Questions
To ask the Manager to provide full details of the planned Christmas tree recycling service for January 2011 in the Lucan area?
To ask the Manager for an update on the ongoing review of the Council's Play Policy and to request that provision of a children’s play-area in Palmerstown be included in the revised policy?
To ask the Manager to arrange for the removal of hedging along the Celbridge Road at Kew Park estate i.e. “ the Daisy Patch” and for the removal of hedging leading to Weston Park Estate from this area. The removal of this hedging will help mitigate localised problems relating to vermin infestation and anti-social behaviour?
To ask the Manager to have the writing on the name stone at the entrance to Kennelsfort Green restored as it has become invisible and a number of public service vehicles have had serious difficulties in locating houses in the estate recently, luckily there was not any tragedy as a result, but there could have been?

That this Committee, noting the contents of the reply to Question 16 at the ACM of 23rd November, requests the Manager to provide a Christmas Tree Re-Cycling Collection in the Lucan EA, in early January, for the following reasons:
1. This is the first Christmas since the closing of the Esker Re-cycling Centre.
2. The Brown Bin System has only recently been introduced in many parts of the EA, and householders are still getting used to the system, how best to use it etc.
3. It is not feasible to expect that a significant number of households will be prepared to cut up, pack etc. trees which in many households are quite large, and this method of disposal is likely to be beyond the ability of elderly householders.
4. The use of the Brown Bin for waste/surplus food is likely to increase very substantially in the period around Christmas/New Year, and there will not be room for chopped up trees.
That this Committee requests the Manager to present a detailed report for discussion on the matters to be considered in progressing implementation of Specific Local Objective 25 of the newly-adopted County Development Plan 2010-2016, i.e. to "facilitate completion of the boundary fence that separates Bewley Grove and Mount Bellew Way running eastwards as far as the Outer Ring Road".
That the Manager would consider allocating a small section of Griffeen Valley Regional Park as a "Dog Park" whereby residents can allow their dogs exercise without dog leads, and that this initiative be introduced as a pilot project, and that this pilot project would incorporate the usual dog litter regulations. As previously stated such a facility has been requested by quite a number of residents who would be very supportive of such a new initiative in South Dublin County Council.

That this Committee requests the Manager to write to the Department of Education and Skills, drawing its intention to the policy statement in the new County Development Plan supporting the location of Childcare/Crèche Facilities on or adjacent to Primary School campuses, and recommending to the Department that in planning its next permanent Primary School in Lucan, in particular at the site acquisition stage, it gives serious consideration to providing for a Childcare/Crèche Facility adjacent to the school.
Environment
Questions
To ask the Manager, further to my repeated motions seeking introduction of a permanent hand-cart service in the Lucan South area, to update on my request that this matter be examined as part of reforms that may be proposed and introduced under the Croke Park agreement?
To ask the Manager if he will provide a report on the problem of illegal dumping in Lucan and Palmerstown, giving information on the extent of illegal dumping in 2010 compared to recent years, an account of the measures taken by the Council to address the problem, and a figure, even if approximate, of the cost to the Council in removing illegally dumped material (as distinct from litter) in 2010?

In view of the fact that the level of dumping and fly tipping in the back lanes in Palmerstown, especially close to the Primary Schools, has reached crisis point, that the Manager bring forward a plan for consideration and the subsequent approval of this Committee so that this blight on the Palmerstown Community, which is also a drain on the resources of this Council, can be eliminated once and for all.
That this Committee expresses its continuing disappointment at the manner in which SDCC bins are returned in the Lucan area by the waste management staff following them being presented for collection.

Questions
To ask the Manager for a detailed update on negotiations with the developer of Adamstown SDZ on the provision of a Community Aquatic and Sports Complex?

That this Committee re-affirms and will not give up on its commitment to the provision of a public Swimming Pool in Lucan, condemns unequivocally the decision, supported by all the Coalition parties and members including FF, Green and Independent Dáil Deputies representing Lucan, to abandon, after the relevant Government Department had led this Committee and the Council "up the garden path" for years, including the years of the dear departed Celtic Tiger, by giving repeated written replies referring to the re-opening of the Swimming Pool Programme, the scheme of financial support for Local Authority Swimming Pools, recognises that this betrayal of the Lucan Swimming Pool Project, combined with the collapse in Development Levy income to the Council makes it very difficult for the Manager to raise the necessary finance for a Swimming Pool Project, nevertheless requests the Manager to meet with Lucan EA Councillors to discuss and explore any options that might be open to the Council, and the community of Lucan, to bring a Lucan Swimming Pool project to fruition.
That the Manager would present a detailed report for discussion on the long-awaited and planned Swimming Pool for the Lucan area. In the light of years of effort and representations by the Lucan community and Lucan Public Representatives, including many Motions passed by the Council and Area Committees in pursuit of this water leisure facility, and the Manager's efforts to provide a Swimming Pool for Lucan, that the Manager would report on his most recent efforts and discussions with the Department of Tourism, Culture and Sport and the Department's response to our most recent request for funding through the Swimming Pool Programme, and what alternative initiatives, including possible joint ventures can be explored to deliver a Lucan Swimming Pool.
That the Manager agrees to a deputation meeting with the Rosse Court Resident's Association to investigate resident's issues.
Roads
Questions
To ask the Manager to outline all measures being pursued, including traffic light co-ordination and re-sequencing, installation of new road markings etc, in an effort to tackle the serious traffic tailbacks on Newcastle Road in Lucan?
To ask the Manager to write to the National Roads Authority to request a meeting with the elected members of this Committee and relevant managers and engineers from the Road's Department to discuss the future possible reopening of the Tandy's Lane - N4 link road as provided for in SLO 19 of the new County Development Plan. It is noted that this road link was successfully and safely reopened to facilitate the recent Lucan Festival. It is also noted that in their submission on the amendments to the draft Development Plan the NRA indicated that they “remain available to discuss the situation with the Council” (submission ref. 0023).
To ask the Manager if the traffic survey I requested into traffic movements between the junction at the N4/Oval and the junction of Kennelsfort Road/Wheatfield Road in both directions has been completed and when will it be brought before this Committee?
To ask the Manager to arrange the examination of the recently installed distribution box outside No 39 Oak Court Lawns as it is already a focal point for anti-social behaviour and appears to have been installed without any consideration for the impact it may have locally. Secondly, does such a retro-fit of a public utility require planning permission or/and does the local authority have to be consulted and if yes was it and what was the input into the decision to locate at this point?
To ask that the gullies in the Dingle, particularly that outside No 10, cleaned out as a matter of urgency as many sections of this roadway are subject to regular ponding and flooding?
To ask the Manager if the Council supports, in any way, the installation of Christmas lights? Would the Council would be supportive of an initiative by local businesses in Lucan to put Christmas lights on the trees on the public footpaths around the Village Green in Lucan?

That this Committee recommends that the Manager requests the Park's Department to plant suitable fast growing trees on lands owned by the Presbyterian Church alongside the N4 in Lucan, following the removal of trees from the piece of land acquired from the Church lands for the N4 Upgrade Project, to reduce the noise levels which have increased substantially at this location as a result of the removal of the trees.
That the Manager will explore initiating a scheme and supporting schools in the Lucan area to encourage cycling to school. As part of the initiative that a pilot school would be chosen to determine the effectiveness in providing: a) road safety education to cyclists b) education on the health benefits of cycling and c) practical facilities such as bike racks.
That the Manager would set out the schedule leading to the introduction of the agreed School-Time Heavy Goods Restriction on the Newcastle Road, Lucan, in keeping with Council Policy as included in our County Development Plan, as agreed with Council Management, and that specifically this new and agreed measure will be introduced on 1st January 2011.
That this Area Committee recommends again that South Dublin County Council, subject to the Garda Commissioner’s approval, implement a school-time HGV restriction on Newcastle Road in Lucan without any further delay.
That this Area Committee, noting the findings of the report, presented at the November meeting, on traffic congestion in the Lucan South area; and noting in particular that MOVA-recorded vehicle usage of Outer Ring Road junctions in 2010 was at, or in excess of, projected usage in 2019; and further noting the significant safety risks posed by motorists queuing side-by-side on the approach roads and encroaching onto cycle-lanes; RECOMMENDS that the Manager implement junction improvements to the Ballyowen/ Willsbrook, Castle Road (Penny Hill) and Griffeen Avenue junctions, including traffic light re-sequencing and creation of new dedicated filter turning lanes on the approach roads to the ORR; and requests the Manager to present detailed drawings showing such proposals for discussion with the elected members.
