QUESTION NO. 1

QUESTION: Councillor W. Lavelle

To ask the Manager for a further update, including a likely timeframe, for completion of the taking-in-charge of Larkfield and Mount Bellew Estates in Lucan, both of which were developed by Fitzgibbons Bros?

REPLY:

The developer of Larkfield and Mount Bellew is Fitzgibbon Bros.

In respect of Larkfield, the taking in charge process is now at the point where CCTV is required so that the Council may establish if underground services are completed to the required standard. Surface items are currently generally acceptable, with some very minor items to be attended to.

Once received, if a review of CCTV indicates that underground services are acceptable and the minor surface works completed, then the Council will be able to initiate the statutory taking in charge process.

In respect of Mount Bellew surface works are generally acceptable, again the significant remaining issue being the provision of CCTV and as constructed drawings.

In respect of the provision of the CCTV and drawings for both developments the Council met the Construction Industry Federation in November (the bondholder for these developments) and advised that the Council will place a claim on the bonds unless the necessary matters are attended to. The CIF has indicated that they will liaise with the developer to obtain these surveys and drawings as a priority.

Finally in respect of open spaces, the open spaces at Larkfield Estate have been taken in charge since July 2010 and works have been completed to open spaces at Mount Bellew, though the open space is not yet formally taken in charge in this development.
