That the Manager would present a report at the March Area Committee Meeting on the An Bord Pleanála decision on the proposed Shelbourne Homes development on lands adjacent to Griffeen Avenue, Oldbridge/Rossberry/Tullyhall Estates, Lucan, the Report to include an account of how the approved Planning Scheme complies with the number of residential units set out for the total Kishogue LAP lands.

While commending Management and staff for their recent efforts, as a follow up to the offer made by Management in the Report to my Motion (Ref ID 24108) at the September meeting and following the subsequent report on CCTV at the Jan 2011 LCA, and as a follow up to the issues I raised in May and October 09 and Jan 10 and since, this Committee calls on the Manager to have movement sensitive lights and CCTV installed on Glenaulin Park where it bounds Culmore Road, Glenaulin Road and Glenaulin Green.  Residents, many of whom are Senior Citizens, living in these areas have to endure an unacceptable level of anxiety, spilling over at times into total fear and intimidation,  due to anti-social behaviour that results in constant worry, fear and disturbed sleep.  In addition, Park users including young children, are in constant danger from quads, broken glass and other fall-out from un-controlled vandalism. It is very much in keeping with the Councils policy of reducing the cost of yesterday that such a pilot scheme be introduced in a park such as Glenaulin that was developed during an era when the problems associated with such back-lands could not be anticipated.  This Council owes it to its citizens that we protect them today from the trauma resulting from the effects of yesterday's decisions and today's vandalism. The situation has now reached the stage where some residents are at breaking point and urgent strong action is called for.

Given the huge public interest and support and the unprecedented cross-grouping support of the elected members, notwithstanding the recent briefing provided to the members of this Committee, this Committee calls on the Manager responsible to set in motion the process for extending the Liffey Valley SAAO as was provided for in the 2004-2010 CDP and is again contained in the 2010-2016 CDP recently voted on by the elected members and that the Manager provide a firm date when a report on the matter be brought to a meeting of this Committee for debate, recommendations and action.

That the Manager inform this Committee if there is any intention to carry out a programme to inspect and replace damaged bins in the Tallaght area. There are a large number of  green bins, possibly damaged during the adverse weather conditions or through other means. Some of the bins contain materials other than that which can be recycled.

That this Committee requests the Manager to expedite the long-awaited taking-in-charge of the large grassed area along the access road from Griffeen Avenue to Rossberry, Tullyhall and Hayden’s Park Estates.

As a follow up to my previous motions and questions on the matter, with reference to the:-  Planning permission granted on 31st October 1989 by An Bord Pleanála under Register Reference 88A/666 and PL/6/5/78396 for the construction of 91 houses at Riversdale, Lucan Road, Palmerstown, Co. Dublin.

Which included at  Condition No. 9 of the Grant of Planning Permission stated inter alia:

The walls at the rear of the proposed houses numbers 2 to 24 and along the western boundary of the site shall be retained at their existing heights and shall, prior to the construction of any of the houses hereby permitted, be repaired, made good and improved, where necessary, with walling that matches the said walls..

The above condition relates to several boundary walls of various dwellings constructed on the lands.

In 1999 the Council issued High Court proceedings under Section 27 of the Local Government (Planning & Development) Act 1976 against Caslan Developments in respect of the outstanding works to be carried out in order to bring the estate up to taking in charge standards.  The proceedings included the non-compliance with Condition No 9.

An adjournment of the case was sought by the developer and this was agreed to by the Council in order to allow negotiations to be carried out.  After several further adjournments, the case was adjourned generally with liberty to re-enter in February 2000.

A recent report on foot of one of my motions stated "having regard to the length of time that has elapsed in this matter, enforcement under Planning legislation is no longer possible".

That the Manager please provide answers to the following three questions:

  1. Why was the relevant planning condition not enforced as set out in the planning permission?
  2. On whose behalf, or why, did the Council bring legal proceedings?
  3. Why did the Council not pursue the matter through the Court, why was the case withdrawn and when withdrawn why was it not re-entered within the statutory period?
