That this Committee calls on the Manager responsible to put right the boundary wall between the Council owned Waterstown Park and the back gardens of residents on Riversdale Grove.

As was contained in an answer to a question I raised at this Committee in June of this year, “Planning permission was granted on 31st October 1989 by An Bord Pleanála under Register Reference 88A/666 and PL/6/5/78396 for the construction of 91 houses at Riversdale, Lucan Road, Palmerstown, Co. Dublin.

“Condition No. 9 of the Grant of Planning Permission stated inter alia:

“‘The walls at the rear of the proposed houses numbers 2 to 24 and along the western boundary of the site shall be retained at their existing heights and shall, prior to the construction of any of the houses hereby permitted, be repaired, made good and improved, where necessary, with walling that matches the said walls…..’

“The above condition relates to several boundary walls of various dwellings constructed on the lands.

“In 1999 the Council issued High Court proceedings under Section 27 of the Local Government (Planning & Development) Act 1976 against Caslan Developments in respect of the outstanding works to be carried out in order to bring the estate up to taking in charge standards.  The proceedings included the non-compliance with Condition No 9.

“An adjournment of the case was sought by the developer and this was agreed to by the Council in order to allow negotiations to be carried out.  After several further adjournments, the case was adjourned generally with liberty to re-enter in February 2000.

“Having regard to the length of time that has elapsed in this matter, enforcement under Planning legislation is no longer possible.” (End of Report)

The wall is now in a dangerous situation and is patched with inferior material and is held together at one location by galvanised iron. The failure to enforce planning conditions should not now result in the residents concerned to have to live with the danger and be responsible for any causality that may ensue. Residents paid development levies and are entitled to a commensurate level of service from the Local Authority.

That this Council would agree, given the commitment made by South Dublin County Council to have the Liffey Valley lands, including at St. Edmundsbury, Woodville and Fonthill, preserved against housing development following the passing of my Motions, including at the June 2008 Planning Department Meeting: "That this Committee requests the Manager to write to the Minister for the Environment and Local Government requesting the Minister to make a Ministerial Order, under Section 202 of the Planning and Development Act 2000, to make further Special Amenity Area Order(s) to preserve the Liffey Valley Lands in South Dublin, including at St. Edmundsbury and Woodville.  Particularly in view of the unanimous decision of South Dublin County Council expressed in my Motion passed in South Dublin County Council on 10th March 2008, including “it is wholly undesirable that any future housing developments take place in the Liffey Valley, including at St. Edmundsbury and Woodville, that would undoubtedly further damage the Liffey Valley Park as did, for example, the earlier housing developments at Laraghcon”, in the interest of the preservation of these lands, and given subsequent Motions passed that prompted further correspondence between the Council and the Minister for the Environment and Local Government, to initiate the process of extending the Special Amenity Area Order given the obvious reluctance by the Minister to exercise his powers in extending the Special Amenity Area Order(s), especially given the pre-general election promise by the Green Party in 2007 to extend the SAAO to these lands, and particularly given the Minister's silence on this matter in advance of the review of the County Development Plan - the time-scale that I had identified in my Motion to this Council on 9th June 2008.

That this Committee reaffirms its commitment to the preservation of the Liffey Valley and to the long-term development of a Liffey Valley Park. However, in the short-to-medium term this Committee recommends prioritisation of efforts to establish: 

  • A structure similar to the Dublin Mountain Partnership to bring together more local authorities and other stakeholders for the common purpose of coordinating the preservation and appropriate development of the valley's environmental, recreational and tourism amenity and potential;
  • Delivery of an interconnecting network of walking routes along and through the Liffey Valley;
  • Creation of a coordinated signage, information and web strategy to highlight the Liffey Valley and provide details on walking routes etc.

Further to my question at the May 2010 meeting, to ask the Manager to convene, without any further delay, the long-awaited on-site meeting at the old Lucan-Clondalkin Road embankment between Moy Glas and Castle Riada estates to be attended by officials from the Parks, Planning and Roads Departments, Gardaí, residents' representatives and the elected members so as to allow for discussion of proposals to address the very serious problems of anti-social behaviour in this area including recently the highly-dangerous throwing of projectiles from the embankment at houses in both estates?

To ask the Manager, further to my motion at the June meeting, to update on efforts to progress the taking-in-charge (and interim grass-cutting) of Griffeen Glen Courtyard and Boulevard, in particular noting the position of the developer that they do not have capacity to prepare the required legal or as-built drawings; and to also advise firstly on the progress of any discussions on this matter with the original planning applicant and secondly on the possibility of accepting the offer made by a leading civil engineering firm (via a local resident) to prepare the necessary drawings?

That the possibility of installing a cost effective CCTV system, such as Net Surveillance, covering the areas “between The Covert and Kennelsfort Road”, “Glenaulin Park”  and "approaches to/and Waterstown Park" be examined and a report brought to this Committee for consideration and possible action by means of a pilot project.  These areas are used as a hangout for anti-social behavior including drinking parties and are perpetually strewn with empty beer cans, broken bottles, remnants of fires and general litter.  Despite the best efforts of dedicated workers from this Council the areas concerned continue to be focal points for anti-social gatherings, are very difficult to adequately monitor and are anything but pleasant places to have to pass through or to live beside.

That an inspection be carried out as a matter of urgency on safety factors in Whitethorn Estate especially Whitethorn Drive where young children are using the gradient in the footpath as a skateboard track and "bouncing" out onto the road making it extremely dangerous.  There have been a few near accidents and it is imperative that the Council act without delay by erecting a barrier of some kind.

That this Committee, recognising the significant value of the Allotments to residents of this area in economic, social, health and recreational terms, calls on Management to;

Retain the rental at the current rate for 2011;

  • Ensure that the charges for Social Welfare recipients be maintained;
  • Provide for those on state pensioners e.g. retired teachers, Gardaí etc will be entitled to the same rates at the Social Welfare group;
  • Explore ways in which plot holders can be more actively involved in the management and maintenance of the allotments on a site by site basis
  • Set up a small standing committee or working group composed of representatives of the plot holders, council management and Councillors (in a ratio to be agreed) that will provide for ongoing liaison and a communications vehicle that will support quality management of this public service.

That this Area Committee recommends that South Dublin County Council initiate the statutory process as laid down in the Derelict Sites Act 1990 to enter both the Molloy site at Coolamber, Newcastle Road and the Eleveden Properties site between the existing Tullyhall Estate and the Adamstown Link Road onto the Register of Derelict Sites for the reasons that these site presently detract from the visual amenity of their area and pose potential public health and safety risks; and furthermore requests that the Council use the proceeds of any derelict sites levy imposed on the owners of these sites to fund works to generally tidy-up and make safe these sites including securing the boundaries of the sites from trespassers.

That the Manager would present a detailed report for discussion on his proposals, in association with Waterways Ireland, to resolve the ongoing and unacceptable problems being experienced by the residents of Clondalkin adjacent to the Grand Canal, including horses being unattended, motor cyclists, litter including horse dung etc. Such problems, including anti-social issues in Omer House, are the cause of great distress for local residents in the local community. That the Manager would also invite an official from Waterways Ireland to attend this Area Committee Meeting to participate in the debate and present Waterways Ireland's proposals at this Area Committee Meeting.

To thank the Manager and staff for the work done on cutting the grass verges on the Cloverhill Road and the grass verge at the footpath between the Maxol Station and the Oval, and to ask what, if any, has been the outcome of the meeting with the NRA on securing additional funds for the maintenance of national routes?  The median along the very small stretch of the N4 between the County Boundary at Chapelizod and the Kennelsfort Road junction at Palmerstown in a National disgrace.  Recently there was some work done on both the median  and the grass verges along the N4 between the Kennelsfort Road junction and the M50/N4 interchange (we think by the M50 construction crew).  This work was observed being carried out safely with the minimum of “protection”.  This Committee calls on the Manager responsible to maintain the median and verges of the N4 to a standard that reflects the fact that it passes through a residential area Palmerstown. (The median west of the M50/N4 interchange has a concrete barrier and no grass).

That this Committee requests the Manager to immediately proceed with the necessary Traffic Count on the Main Street, Lucan Village, in the vicinity of La Banca restaurant to establish the need for  a pedestrian crossing at this location, and that the Manger requires that the criteria for analysis of the Traffic Count Data, be adjusted from the normal criteria to have regard to the fact that a large number of the pedestrians crossing the road at this location are elderly, being residents of Sarsfield Park and Close, the Village and adjacent older parts of Lucan.

That this Area Committee, on foot of the decision by the elected members of South Dublin County Council to amend the draft Development Plan to omit the long-term local road objective “Esker Lane to Esker Meadow View”, requests that the Road's Departments cease all efforts and drop all plans to open this road link and instead seeks to offer this strip of land for disposal to the Department of Education and Skills, as part of any land disposal involving lands at the former Esker Green Waster Recycling Facility, for the purposes of providing a safe drop-off and turning point for Gaelscoil Naomh Padraig and Coláiste Cois Life.

That the Manager immediately installs ramps (similar to ones on the old Ballymount Road where the 56a goes) on St John's Lawns, Clondalkin as a deterrent for speeding. Residents are asking why the road is being resurfaced when the road is perfect.
