Minutes of the Lucan/Clondalkin Area Committee Meeting 15th April, 2009

To ask the Manager the following questions relating to previous motions for planning permission at the Roma Take-Away, Rath Gael and that the Manager addresses the following issues as a matter of urgency:-

• Ventilation system - the compliance documents supplied are for a different, and apparently inferior system, to the one specified with the planning application. As this is a material change to the application, with serious implications for the odour pollution of the apartments above, does this not require a new planning application?
• Drainage system - has the system been physically checked to ensure that there is a proper grease trap installed?
• Refuse - where is the storage area located?

To ask the Manager to ask Roma to submit a new planning application in relation to the noise from the extractor fan which was unbelievably loud in spite of the fact that it was daytime and there was obviously a lot of other noise from traffic etc. At night time it would be unbearable!  Is this in breach of Condition 8 of the planning permission? Also, the ventilation system that has been installed is different to the one specified on the planning application.

Significantly, the decision on the retention application for the roller shutter (SD09/0067) is that it is a material alteration to the application and therefore Roma has to effectively make a new application. Given this, is the change of ventilation system a material alteration and therefore should this also require a new application?

To ask the Manager for a report on the proposed new road provided for in the Adamstown SDZ Planning Scheme to replace Tandy's Lane as a distributor road, linking the Dodsboro Road to the Newcastle Road and if he can give an indication of the date by which this road will be completed and opened?

To ask the Manager if the discussions between the Council and the Department of Education and Science to identify a suitable site for the Lucan South Second Level School, which has already been approved by the Department, have concluded and if he can advise on the location of the agreed site, and when it is anticipated the purchase of the site by the Department will be completed?

To ask the Manager if any approach has been made to the Council to identify a suitable site, on Council lands or other lands, for Esker Educate Together National School, currently housed in temporary accommodation in Adamstown?

That this Area Committee expresses its concern with regard to a number of matters relating to the proposed development at Clonburris as per the Planning File SD09A/0149, 14^th April 2009, Shelbourne Development Ltd., Kishogue, Lucan, Co. Dublin, including: development of eight storeys high, such high density in this proposed development, the prospect of the elimination of the boundary walls between the proposed development and the exiting and established local residential development in the South Lucan area, and the potential car parking, traffic and congestion related issues in local adjoining and nearby housing estates in the South Lucan area.

That this Committee requests the Manager to note that on two successive occasions An Bord Pleanála has refused planning permission for 6 new aircraft hangers at Weston aerodrome, Lucan for reasons that include "......the proposed development would constitute a greatly expanded development resulting in a significant intensification of use of Weston aerodrome which would be inconsistent with the existing use and character of the aerodrome." The Board also reports that it is not satisfied that this intensification of use would not seriously injure the amenities of the area or of property in the vicinity. An Bord Pleanála concludes that the "proposed development would, therefore, be contrary to the proper planning and sustainable of the area." Would the Manager also report in detail on the planning history associated with the original west end entrance to Weston Aerodrome on the Celbridge Road?

That a report be brought outlining how a funfair could operate at 9th Lock Road at the site of Old Paper Mills which is a derelict site. Is there any permit record or permission granted and to enquire as to what were the traffic and toilet arrangements?

That the Manager presents a report on the unauthorised encampment beside Palmerstown Woods, Clondalkin and indicates how long this is going to be an issue for local residents.

That a report be brought outlining the present planning status situation regarding the Old Paper Mills site at 9th Lock Road, Clondalkin.

That this Committee is disappointed at the long delay in finalising the taking in charge of Tullyhall and Rossberry Estates, Lucan and requests the Manager to present a progress report and advise if the Council is experiencing difficulties with the developers concerned in finalising outstanding works in either or both estates?

To ask the Manager for a report on the number of applications and approvals for house improvement grants, including Grants for Older People, Mobility Gnats and Disability Grants, made in 2008 to residents of Lucan and Palmerstown and to-date in 2009 and if the Manager is satisfied with the level of funding made available from the Department of Environment, Heritage and Local Government for the schemes?

That a report be brought re ongoing anti social activities at Lindisfarne Avenue and Lindisfarne Drive and that this Council place bollards at Lindisfarne Drive to stop louts escaping by driving over the green on to Lock Road.

This Committee recommends infill housing for the open ground between 16 & 18 Lindisfarne Green, Clondalkin and asks the Council to come up with a proposal for this recommendation.

To ask the Manager how many swans have been killed recently in Corkagh Park and the cause of their deaths?

a. To prune back the shrubs and remove the litter in the shrubs along the gable wall of the houses on the open space at the entrance to Lindisfarne Grove for Lealand Road?

b. Provide the local environmental group with flowers which local young children could plant at the entrance to the Estate?

To ask the Manager to erect a 'Thieves are Operating in this Area' sign in the car parks at Corkagh Park, Clondalkin?

To ask the Manager to report on the availability of Litter Bins in parks in the Lucan and Palmerstown areas and in particular to state if the Council is satisfied that this aspect of the Litter service is satisfactory, i.e. sufficient bins and that they are emptied often enough, so that it encourages people to respect the environment and our Litter laws?

To ask the Manager to have the grass cut on the Cloverhill Road, Clondalkin and to generally tidy up the area as it is in very unkempt condition?

To ask the Manager how often Glenaulin Park, Palmerstown is patrolled each day, how often broken glass is removed and to report on the level of vandalism that takes place in this park and what steps the Council has/will take to address the situation?

To ask the Manager if he will write to the person (name and address supplied) who according the Land Registry is the owner of a semi-detached house in Lucan (address supplied), which has not been occupied for some time, in which the main kitchen widow has been removed, which is a location for anti-social activity and which may be a health hazard due to full refuse bins and other litter, and request the owner to secure and make tidy/safe the house?

That this Committee requests the Manager to support Lucan United in it's efforts to provide All-Weather Playing Facilities to its players. Lucan United has a very long and proud tradition of providing facilities for its members and is disappointed that NO Sports Capital Grant Aid has been provided for Lucan's Soccer Club's All-Weather Facilities Partnership Application. It is imperative for the future development of the Club that every effort is made and every support is given for the most recent effort for All-Weather Facilities at Lucan United.

That in view of the condition in the Planning Permission for Rosse Court that the Playground provided be open to the public, and noting the severe damage done to the Playground by recent vandalism, that this Committee requests the Manager to investigate how the Council can provide resources to refurbish the Playground, and to consider what measures the Council could take to assist residents and the Management Company make the facility secure and safe for use by families in Rosse Court?

That this Council only installs seating at that part of the canal that is not backing onto houses - e.g. St. Patrick's Estate and Oakwood Estate.  Residents are concerned that seating will lead to loitering at the backs of their homes.

That the Manager presents a report on the Bawnogue Enterprise Centre including in it the following items:

(a) Who and what organisations control the operation of the Centre?

(b) The role of South Dublin County Council in the Centre.

(c) The level of rents and the extent of occupancy.

(d) Whether or not Stewart's Hospital can maintain their restaurant in that location.

That this Committee calls on the Manager to ensure that the refurbished Lucan Weir is open for public use before the beginning of this Summer.

That this Council installs a bin between the Spar Shop and the Newcastle Community Hall and reinstates the two trees that were there. To cut the grass between Peamount Road and the Community Hall and for a more frequent visit from the depot to the area to cut the grass.  Has Newcastle been moved from the Rathcoole Depot to the Esker Depot?

To ask the Manager to have two extra lights installed at the bungalows around No 12 Lindisfarne Grove?

To ask the Manager to present an up-to-date report on the road improvement works at the junction of the M50 and the N7 (Red Cow) and could he also outline what he intends to do to protect traffic from missiles thrown from the fly-over bridge between the Red Cow Luas stop and Monastery Road, Clondalkin?

To ask the Manager are there any plans to install public taxi rank spaces on Orchard Road / Main Street / Tower Road, Clondalkin?

To ask the Manager to agree to install a Pedestrian Crossing at the northern section of the traffic lights on the Outer Ring Road at the Penny Hill, Lucan? The Manager previously agreed to revisit this matter on my request, and lately it has been reported to me, and I have witnessed myself on many occasions, local residents, including young children, being exposed to serious dangers in crossing the Outer Ring Road at this location.

To ask the Manager to report on what measures he will introduce to resolve the safety issues on the footpaths on the Lucan Road west of Lucan Village?  Recently for example, a local resident was hit on the head by the mirror of a bus while walking on the narrow footpath towards Lucan Village at the Allied Irish Bank, Lucan.

To ask the Manager to report on the damage that has been caused to the wooden barriers along the M50 and include in his report what system is in place to monitor these barriers and what steps can be taken, if the damage was caused by vandals, to ensure that they will not be further vandalised?

To ask the Manager to report on the new signage on the M50 and the N4 and to state if he is satisfied that it is acceptable and accurate and if it is deficient, what remedial action is proposed to set it right given the number of motorists who complain of missing their lane, some of whom have reported near misses due to drivers attempting to switch lanes at the last minute?

To ask the Manager if he can arrange to have the footpath on the right hand side of the road where Chalet Gardens exits onto the Old Lucan Road inspected as residents have complained of the risk of hitting the footpath when taking a left turn from Chalet Gardens?

That this Area Committee requests the Manager to agree to prepare a new Part 8 Procedure for the Tandy's Lane/N4 junction, Lucan, that will allow car traffic to exit from Tandy's Lane onto the N4, and that the Manager will also seek the support for this initiative from the National Road's Authority as requested by this Area Committee. The closure of this road link will result in further traffic congestion in the Lucan area north of the N4, including in Lucan village, which will further threaten Lucan village's economic and environmental sustainability.

That the Manager arranges to provide a Public Taxi Rank in Clondalkin Village. The rank should be located in front of Quinlan’s Pub, Orchard Road, Clondalkin.

That the Manager provides a report on fines issued in the past three years (broken down annually) to drivers of HGV’s in the Clondalkin Village 3 tonne restriction zone.

That this Committee notes the start dates given for the second and third traffic calming schemes in the Lucan electoral area viz. that the scheme for Griffeen Glen and adjacent estates will not start until later in 2009, and that the scheme for Liffey Valley Park/Mount Andrew and adjacent estates will not start until 2010.  That the Committee understood that both schemes would start in 2009, calls on the Manager to start the planning and consultation process for both schemes immediately and requests the Manager to make a report on the amount provided in the 2009 budget for work on the two traffic calming schemes.

That an update be brought to this Committee regarding progress with access/egress at Tay Lane in view of recent response (belated) regarding going to tender.  That the Manager outline the costs to be incurred, that the money is ring-fenced and immediately available.  What is the start up date of the proposed works?

That the Manager presents a report on Tuthill's Car Park, Clondalkin Village indicating clearly by drawing which area is under the control of South Dublin Co. Council and which area is privately controlled.

That this Committee determine that the Manager responsible prepare and implement a Part 8 consultation for a traffic management scheme (for submission to An Bord Pleanála) that will provide for a left out for all motorised traffic at Ardeevin, Lucan.

That this Committee make it policy to

a) act as fast as possible to remove tolls on the main bridges M50, N1, N3, N4 and

b) that costs are minimised on public road contracts so that there is little or no cost to the tax payer regarding tolls, especially on the N7 / Naas Road Portlaoise and N7 / Naas Road Limerick.
