To ask the Manager the following questions relating to previous motions for planning permission at the Roma Take-Away, Rath Gael and that the Manager addresses the following issues as a matter of urgency:-

  • Ventilation system - the compliance documents supplied are for a different, and apparently inferior system, to the one specified with the planning application. As this is a material change to the application, with serious implications for the odour pollution of the apartments above, does this not require a new planning application?
  • Drainage system - has the system been physically checked to ensure that there is a proper grease trap installed?
  • Refuse - where is the storage area located?

To ask the Manager to ask Roma to submit a new planning application in relation to the noise from the extractor fan which was unbelievably loud in spite of the fact that it was daytime and there was obviously a lot of other noise from traffic etc. At night time it would be unbearable!  Is this in breach of Condition 8 of the planning permission? Also, the ventilation system that has been installed is different to the one specified on the planning application.

Significantly, the decision on the retention application for the roller shutter (SD09/0067) is that it is a material alteration to the application and therefore Roma has to effectively make a new application. Given this, is the change of ventilation system a material alteration and therefore should this also require a new application?

That this Area Committee expresses its concern with regard to a number of matters relating to the proposed development at Clonburris as per the Planning File SD09A/0149, 14th April 2009, Shelbourne Development Ltd., Kishogue, Lucan, Co. Dublin, including: development of eight storeys high, such high density in this proposed development, the prospect of the elimination of the boundary walls between the proposed development and the exiting and established local residential development in the South Lucan area, and the potential car parking, traffic and congestion related issues in local adjoining and nearby housing estates in the South Lucan area.

That this Committee requests the Manager to note that on two successive occasions An Bord Pleanála has refused planning permission for 6 new aircraft hangers at Weston aerodrome, Lucan for reasons that include "......the proposed development would constitute a greatly expanded development resulting in a significant intensification of use of Weston aerodrome which would be inconsistent with the existing use and character of the aerodrome." The Board also reports that it is not satisfied that this intensification of use would not seriously injure the amenities of the area or of property in the vicinity. An Bord Pleanála concludes that the "proposed development would, therefore, be contrary to the proper planning and sustainable of the area." Would the Manager also report in detail on the planning history associated with the original west end entrance to Weston Aerodrome on the Celbridge Road?

That this Committee requests the Manager to support Lucan United in it's efforts to provide All-Weather Playing Facilities to its players. Lucan United has a very long and proud tradition of providing facilities for its members and is disappointed that NO Sports Capital Grant Aid has been provided for Lucan's Soccer Club's All-Weather Facilities Partnership Application. It is imperative for the future development of the Club that every effort is made and every support is given for the most recent effort for All-Weather Facilities at Lucan United.

That this Area Committee requests the Manager to agree to prepare a new Part 8 Procedure for the Tandy's Lane/N4 junction, Lucan, that will allow car traffic to exit from Tandy's Lane onto the N4, and that the Manager will also seek the support for this initiative from the National Road's Authority as requested by this Area Committee. The closure of this road link will result in further traffic congestion in the Lucan area north of the N4, including in Lucan village, which will further threaten Lucan village's economic and environmental sustainability.
