"That the Manager furnish a report on any action which he proposes to take to address the poor and unsightly condition of Ashfield House at Brookvale, Rathfarnham."
REPORT
Ashfield House is a Protected Structure listed under the Record of Protected Structures RPS Ref. 208. A site inspection of Ashfield House was carried out by the Conservation Officer on 22/09/06 following a complaint received from a local resident on 21/09/06 in relation to the current condition of the structure.
The Conservation Officer in a report detailed signs of vandalism that were apparent at the time of the site inspection. The front gate was secured and security cameras were visible. There were no signs of unauthorised access into the building but a number of window panes had been damaged and graffiti was evident inside the boundary walls. It was recommended by the Conservation Officer that a Section 59 Endangerment Notice under the Planning and Development Act, 2000 be served on the owners.
A Section 59 Notice can be served on the owner/occupier of a Protected Structure in the event that the Local Authority feels a Protected Structure is becoming endangered or to prevent the continuing endangerment of a Protected Structure. A Section 59 Endangerment Notice has been served on the owners of Ashfield House. This notice requires the owners, within a period of 12 weeks from the date on which the notice comes into effect, to take the following steps to ensure the safety of Ashfield House, a Protected Structure;
The owners are required to contact the Conservation Officer in relation to the above works.
In accordance with Section 63 of the Planning and Development Act, 2000 any person who fails to comply with a Notice served under Section 59 of the Act shall be guilty of an offence.
