EMERGENCY MOTION

MOTION: Councillor M. Árdagh

 

"That the Manager takes every measure available to him to ensure that the mast at 44 Fortfield Park, adjacent to St. Pius X School is removed.”

REPORT:

Complaints were received by Planning Enforcement on 19^th September 2006 in relation to the erection of a mast at 44 Fortfield Park, Terenure, Dublin 6w.

Warning Letter  pursuant to Section 152 of the Planning and Development Act, 2000 dated 19^th September 2006 was served on the land owner and occupiers of the lands in question. 

As a person served with a Warning Letter, he/ she may make submissions or observations in writing to the Planning Authority regarding the erection of the mast not later than two weeks from the date of the service of the Warning Letter i.e. 04^th October 2006. 

Should the Planning Authority, following investigation, consider that the mast as erected or other unauthorised development has been/is being/may be carried out, it may decide to issue an Enforcement Notice under Section 154 of the Planning & Development Act 2000. 

The Councillor will be kept informed as this investigation progresses.
