MOTION NO. 14

MOTION: Councillor A.White

"That the Manager present proposals for a monitoring process, involving the local community including residents and community associations, with respect to the Ballyboden Village Area Plan approved by the Council in July 2006."

REPORT:

Section 2.7 of the Ballyboden Village Plan July 2006 states the following in relation to monitoring - “A monitoring report shall be prepared two years following the adoption of the plan”.

 The Planning Department will prepare and circulate to Members this monitoring report within two years of the date of adoption of the Ballyboden Village Plan.  However, the Plan does not include prescriptions as to how this report shall be prepared.

 The Planning Acts do not prescribe monitoring reports for statutory Local Area Plans.  The Ballyboden Village Plan is not a statutory Local Area Plan; it is a guidance document for the development of a largely built up area and is set within the framework of the County Development Plan 2004-2010.

 Any development on the Village Plan lands in Ballyboden would be largely classified as “infill”.  Proposed developments can be adequately addressed in the context of the planning application process, compliance with conditions following a grant of planning permission and/or enforcement procedures.  This would not justify a specific monitoring process as outlined in the Motion.  A progress monitoring report on the Village Plan will however be prepared, as stated, after two years.

 The Planning Department has a very heavy and detailed programme of work to be undertaken over the next number of years – this programme is largely set down in the County Development Plan.  It is not possible to redirect resources from the agreed current and planned projects required by the County Development Plan.
