QUESTION: Councillor E. Ó Broin
To ask the Chief Executive how it is that SDCC granted planning permission for a data centre (SD18A/0068) under specific planning conditions that SDCC laid out, but nonetheless has no role in ensuring the facility is built according to the same conditions and in particular conditions 19 and 20 which refer to noise.
REPLY:
The Planning Authority does have a role to ensure planning compliance and is assessing the issues raised, including compliance with the relevant planning permission and any applicable conditions. Any appropriate action will be considered in accordance with the Planning and Development legislation and the findings of the investigation. SDCC is also liaising with the Environmental Protection Agency (EPA) who have primary responsibility for environmental regulation and enforcement associated with a site which is licensed under an Industrial Emissions (IE), Integrated Pollution Control (IPC) or Waste Licence issued by the EPA.
