MOTION NO. 1

MOTION: Councillor F. Timmons

That this Council, noting the growing concentration of vape shops in certain locations and the limited planning powers available to regulate such development, agrees to write to the Minister for Housing, Local Government and Heritage and the Office of the Planning Regulator seeking amendments to planning legislation and guidance to establish a distinct planning use class for vape shops and similar premises; require planning permission for any change of use to that class; enable local authorities to refuse applications where an over-concentration of such uses would occur; and provide for restrictions on such premises in sensitive locations, including in proximity to schools and residential areas.

REPORT:

If the motion is passed, letters will be issued to the Minister for Housing, Local Government and Heritage and the Office of the Planning Regulator; the responses, when received, will be circulated to the Members.
