QUESTION: Councillor F. Timmons
To ask the Chief Executive for a detailed report into the RIC Barracks Protected Building aka Riverside House and how its protected and how this is enforced?
REPLY:
Riverside House (Former RIC Barracks, Old Nangor Road is a Protected Structure, RPS Ref. 136 under SDCC County Development Plan 2022-2028, Appendix 3A (Record of Protected Structures). As such its protection is governed by Part IV of the Planning and Development Act 2000 (as amended). Under Part IV the owner of the property has a duty of care. The property is in private ownership and currently the Planning Authority have been unable to ascertain the owners details.
Under Section 59 of the Act an Endangerment Notice can be issued whereby the Local Authority considers that specific work is required in order to safeguard the structure. Prior to a Section 59 Notice being served on the owner a Warning Letter is usually issued by Planning Enforcement reminding the owners of the duty of care and obligations under the Planning Acts. A S59 Notice can only be formally issued, when necessary or required works are identified and set out specifically in any notice. The Planning Authority have investigated this site previously and a Planning Enforcement file was since closed and the ownership of the site still remains unconfirmed.
