QUESTION NO. 36
QUESTION: Councillor A. Smyth
To ask the Chief Executive for a list of all housing estates and parks currently undergoing the taking in charge process, together with the current stage reached in that process for each.
REPLY:
A comprehensive list of housing estates currently being actively progressed through the Taking in Charge (TIC) process is attached. The schedule sets out the current stage reached for each estate and identifies the principal actions remaining to enable completion of the process.
Each scheme completion needs the active support of the developers and the support of our specialist SDCC teams to sign off on the satisfactory completion of the different elements of the scheme. For example parks, planning, drainage, roads and public lighting sections must all sign off each specialist element of the estate.
The Council has a number of legacy estates that are not currently being progressed through the Taking in Charge process. Some estates have not formally been offered to the Council to be Taken in Charge, and in most cases like this, there is a legally constituted management company in place to manage the estate. The developer in some cases has gone into receivership, and therefore a key stakeholder is not in place to progress the TIC process. Where the developer has gone into receivership, in some cases a bank's or receiver's agent is appointed to carry out the role normally completed by the developer. Here the bank's or receiver's agents carries out the completion works which assist the completion of the TIC process.
