To ask the Chief Executive if SDCC has ever acquired land by Compulsory Purchase Order for the creation of new sports and recreation amenities
REPLY:
The Planning and Development Act 2000, as amended, provides the statutory basis under which a local authority may, where necessary, acquire lands by way of Compulsory Purchase Order for legitimate public purposes, including the provision of community and social infrastructure such as sports facilities, parks, open space, community centres and libraries.
To date, SDCC has not found it necessary to utilise the Compulsory Purchase Order process to acquire lands for the development of new sports and recreation amenities. In general, the provision of such facilities is supported in the first instance through the zoning and reservation of lands in successive Development Plans.
Where lands are not already in Council ownership, they are typically secured by one or more of the following means:
At present, there are no proposals for the development of sports or recreational facilities that would require the use of the Compulsory Purchase Order process.
