"To ask the Manager if they are aware that an official request has been made to start the TIC process in Marlfield Estate and if they have any insight into when this process may begin?"
REPLY:
There is an official Taking in Charge (TIC) application received for the 52m of footpath and public lighting along Marlfield Row. This is a very small section of the entire estate. This is the only official Taking in Charge application for the Marlfield estate that South Dublin County Council has on file.
The Marlfield Row application (52m of footpath and Public lighting) is in the earliest stages of checking. Our initial assessment is that there are several problems identified with the construction of this area. Unless all built elements are constructed to the South Dublin County Council TIC standards, then the Council cannot take those elements into our charge.
There has been significant correspondence received by the Council in recent weeks in relation to taking in Charge of the Marlfield estate. However, no official Taking in Charge application form has been received by the Council for the vast majority of this estate.
If a valid TIC application were received by the Council for the rest of Marlfield estate, there would follow a detailed assessment of all elements offered for Taking in Charge. If it was found that any elements were not constructed to the TIC standards, then these would need to be rectified by the owner or designated body managing that section of the estate before the Council could complete the TIC process.
