That the Manager refuse the licence application for a Section 254 Licence for an 18-metre telco street pole at the roundabout at Anne Devlin Road/Anne Devlin Park, Rathfarnham. The area is well served with fibre cables. Eir has upgraded fibre to their poles and Vodaphone has also upgraded their Cable-Link network to fibre. The area is also served with similar telco large poles one opposite the Blue Haven Pub at Ballyroan Road. And at the other end of Ballyroan Road at the entrance to Glendoher Estate there is another large telco pole serving the area.
REPORT:
It would not be appropriate for the Planning Authority to comment on an application which is under ongoing assessment.
Generally for such applications, and in accordance with Section 254(5) of the Planning and Development Act 2000, as amended, in considering an application for a licence under this section a planning authority, or the Board on appeal, shall have regard to— (a) the proper planning and sustainable development of the area, (b) any relevant provisions of the development plan, or a local area plan, (c) the number and location of existing appliances, apparatuses or structures on, under, over or along the public road, and (d) the convenience and safety of road users including pedestrians.
Section 12.11.2 of the County Development Plan sets out the requirements that applicants shall demonstrate in the consideration of such proposals. This includes: "On a map, the location of all existing telecommunications structures within a 2km radius of the proposed site, stating reasons why (if not proposed) it is not feasible to share existing facilities having regard to the Code of Practice on Sharing of Radio Sites issued by the Commission for Communications Regulation;".
