QUESTION NO.5

QUESTION: Councillor Y. Collins

To ask for a status update in relation to the current statutory position at Rosebank with respect to planning issues, including the S.154 Enforcement Notice and the S.59 Endangerment Notice, together with indicative timelines for enforcement.

REPLY:

This file is being managed in accordance with the statutory provisions governing planning enforcement and protected structures. 

S. 154: An Enforcement Notice pursuant to Section 154 of the Planning and Development Act 2000, as amended, issued to the owner of Rosebank on 24th March 2026 requiring within the specified period commencing 30th March 2026 and ending 30th April 2026 to take the following steps: -

1.Cease and desist any further work to Rosebank House and Lodge.

2.Restore the lands and reinstate internal layout/structures to original floorplan prior to works being carried out.

3.Do not commence any change of use.

Failure to comply with the requirements of this notice may lead to the initiation of legal proceedings in this matter.

 S. 59:  An Endangerment Notice pursuant to S 59 of the Planning and Development Act 2000, as amended, issued on 15th January, 2026, with two elements to that notice namely:

1. Protection/Safety of Protected Structure elements

2. Conservation repairs/reinstatement of Protected Structures elements under duty of responsibility and care.

A comprehensive report dated 16th February, 2026 was received and has been carefully reviewed.  The works now being approved relate solely to the existing
architectural elements of the Protected Structure. They do not refer to, nor should they be interpreted as authorising any other works that have been carried out, or are
proposed to be carried out, at Rosebank.

The client has been afforded a four-week period from 9th March 2026, for details to be submitted to ensure full compliance with the Section 59 Endangerment Notice.
