QUESTION NO. 5

QUESTION: Councillor L. Dunne

"To ask the Manager to provide a report on the CCTV installed at Montpelier View, outlining the date of installation, operational status, and effectiveness to date, and to confirm whether the CCTV has led to the identification or prosecution of any individual(s) involved in illegal dumping. The report should also indicate whether there has been a reduction in dumping incidents since installation and outline any recommendations for further action?"

REPLY:

CCTV was installed in accordance with the LGMA's 'Code of Practice for the Operation of CCTV for the Purposes of Prevention, Detection & Prosecution of Waste Offences' between the 22nd July 2025 and the 15th September 2025, which focused on  the entrance to Montpellier View. During the deployment of the CCTV there were two incidences recorded that contravened the Waste Management Act 1996, as amended and one incident that contravened the Litter Pollution Act 1997, as amended. The Litter Pollution incident was dealt with by means of the issuing of a fixed penalty notice to the owner of the vehicle involved in the action. In relation to the Waste Management Act incidents, one vehicle recorded was found to have used unregistered vehicle license plates and so the owner could not be identified. In relation to the second incident a file has been prepared and is with the Councils Law Department to initiate legal proceedings.

Towards the end of the deployment of the CCTV system, persons unknown vandalised the installation. As there are still reports of ongoing dumping at Montpelier View,  a repeat installation will be proposed for 2026 when a suitable location is identified.
