QUESTION: Councillor J. Spear

"Can the Manager please give an update on the Taking-in-Charge of land owned by St. Kevin's Church, Kilnamanagh (details supplied).

Please include an estimate of when the process will be complete?".

REPLY:

This a land transfer request, not a taking in charge item as it currently stands. There appears to be land registration issues with the land outlined on the attached map.  The Council firstly has to establish a general public utility in the land.  For example, would the land be of benefit to the general public for amenity or access or for development. Normally, the economic section of the Council would assess these matters.  If this assessment concluded that the benefit to the general public outweighed the cost of the land transfer and other costs, then perhaps this could be progressed.  If the land was transferred/bought, then the lands would come under the management of SDCC and SDCC would maintain the lands in question.

Contact must firstly be made with economic section of the Council to establish a need or purpose for the land.  Taking in charge would follow, if the land transfer process was completed.
