To ask the Chief Executive if the casual trading bye laws recently approved by council prevent SDCC from issuing a trading licence for mobile traders in carpark areas.
REPLY:
The casual trading bye-laws that were approved by Council, apply to all lands to which the Council has in its charge and this includes public car park areas.
Accordingly, SDCC cannot issue a trading licence for mobile traders in carpark areas unless that location is formally designated for casual trading in accordance with the bye-laws. If a particular carpark is not a designated casual trading location, the Council is not in a position to issue casual trading licences for mobile traders operating within carpark areas or any area where such trading would be contrary to the bye-laws.
Under Regulation 22 of the Casual Trading Byelaws 2026 – SDCC reserves the right to establish additional new Casual Trading Areas on a trial basis, by Chief Executive Order. The trial allows for flexibility throughout the duration of the Byelaws and is designed to meet evolving demand in the county. It provides a framework to trial Casual Trading in new locations throughout the county.
These Casual Trading areas may be added to the First Schedule permanently, subject to demand, site specification, and approval from the relevant Area Committee.
Carparks within public parks may be deemed eligible for a trial Casual Trading Licence, should the area in question satisfy the following criteria regulation-22-provision-to-trial-casual-trading-copy.pdf
