QUESTION: Councillor M. Johansson

To ask the Chief Executive for a report on any vacant/derelict property grants applied for or paid out for the derelict property at 35 Wheatfield Road?

REPLY:

As per the Vacant Property Refurbishment Grant application form ‘ An agreement (comprising of the signed Application Form, signed Letter of Approval and signed Charge document) must be concluded between the local authority and the applicant(s) which contains the clawback agreement, including a charge on the property, which shall be binding on the applicant(s) upon drawdown’.

 A grant application can be made for a principle private residence or for a rental property however if the applicant sells the property, or it is no longer available for rent, during the clawback period, the grant funds must be reimbursed to the local authority as follows:

Property sold within 5 years or ceases to be principal residence, or ceases to be a rental property with a tenancy registered with the Residential Tenancies Board.*

Property sold or ceases to be principal private residence, or ceases to be a rental property with a tenancy registered with the Residential Tenancies Board.

Over 5 years and less

than or equal to 10 years*

Property sold or ceases to be principal private residence, or ceases to be a rental property with a tenancy registered with the Residential Tenancies Board.

Over 10 years*

100% of the monetary

amount of the grant is repayable (the “Clawback”)

75% of the monetary

amount of the grant is repayable (the “Clawback”)

No Clawback applies

Information cannot be provided regarding a specific grant application, however as per the information provided above, the grant funds must be reimbursed to the local authority if the applicant is not adhering to the scheme guidelines.
