Headed Item 1 – CE Report
Under section 13 (5)(a) of the Planning and Development Act 2000, as amended, this Special Meeting of the Council is considering the Report of the Chief Executive which is appended to this Headed Item and the proposed variation – the Clondalkin Local Planning Framework (Headed Item 2).
The CE Report has summarised the recommendations, submissions and observations made by the OPR and the submissions and observations made by the public. The report has also summarised the issues raised and the recommendations made by the NTA and EMRA.
The CE Report includes the responses and recommendations of the CE to the issues raised. In some cases, the CE has made recommendations which would make changes to the proposed variation (the LPF) in response to the submissions and these are set out in the report under the relevant chapter and issue heading.
For clarity, where an agreed motion amends a recommendation in the noted CE Report the content of the motion will be integrated into the LPF. Where a motion by way of a decision at the meeting does not make changes to a CE recommendation contained in the noted CE Report, the recommendation will stand and will be incorporated into the LPF. It should be noted that where recommendations in the noted CE Report are considered directly relevant to the CEs response to a motion and / or the associated recommendation they have been outlined.
Any changes to the proposed variation (draft LPF) which are considered to be material alterations will be required to go out for public consultation in accordance with section 13(6) of the Planning and Development Act, as amended.
SEA / AA: In relation to the recommendations contained in the CE Report, taking into account the other measures relating to environmental management and protection that are already integrated into the existing Development Plan and the Proposed Variation, the recommendations for amendments would not give rise to any likely significant effect on the environment or any European Site. Therefore, SEA and Stage 2 AA are not required for these recommendations.
