DECLARATION OF ROADS TO BE MADE PUBLIC ROADS - FOR APPROVAL

TAKING IN CHARGE OF THE AIRPARK SQUARE ESTATE:

REPLY:

This headed item is seeks the Council's approval on the proposal to take the roads listed in the attached roads schedule and the infrastructure detailed in the attached taking in charge map within the Airpark Square estate into the charge of South Dublin County Council.

The following Taking in Charge public notice initiated a public consultation process with publication in the Council's portal and in a local newspaper.  The public consultation took place between the 11^th September 2025 and 23^rd October 2025.

Public Notice:

"In accordance with the provisions of Section 11 of the Roads Act, 1993, South Dublin County Council hereby gives notice of its intention to consider the making of a declaration that the roads listed hereunder be a public roads.

Airpark Square Estate, Stocking Lane, Rathfarnham, Dublin 16

In accordance with the provisions of Section 180 of the Planning & Development Act 2000 as amended, the Council considers the Taking in Charge of the storm drains watermains and public lighting within the attendant ground of the development.  

 This matter will be considered by South Dublin County Council at its Council Meeting on 8^th December 2025.

Maps showing the roads and the areas to be taken in charge, were published separately and were available for viewing at the Council’s public consultation portal at http://consult.sdublincoco.ie from 11^th September 2025 until 23^rd October 2025.

Objections or representations regarding the above proposal could have been be made via the portal or in writing to the Senior Executive Officer, Land Use, Planning and Transportation, South Dublin County Council, County Hall, Tallaght, Dublin 24, D24 A3XC.

The latest date for receipt of postal objections or representations via the portal is the 23^rd October 2025." End of Notice.

Submissions Received:

No submissions were received during the prescribed consultation period referred to above.

SDCC Executive Recommendation:  

The Airpark Square estate and the attendant infrastructure detailed on the attached Taking in Charge map and the roads detailed in the attached Roads Schedule are constructed to the required SDCC taking in charge standard. The SDCC technical team are satisfied to recommend that the estate be taken in charge by the Council from a technical standpoint.

Rathfarnham Area Committees Post Public Consultation Discussion:

The Rathfarnham Area Committee discussed this taking in charge proposal on the 11 November 2025.  The committee noted the details of the proposal and recommended that the item be brought to full Council on the 8 December 2025 for final decision.

TIC Approval Decision:

This Headed Item seeks the approval of this Council to  "Take in Charge the roads detailed in the roads schedule and the infrastructure detailed in the Taking in Charge map within the Airpark Square estate, Stocking lane, Rathfarnham, Dublin 16 in accordance with the provisions of Section 11 of the Roads Act, 1993 and in accordance with the provisions of Section 180 of the Planning & Development Act 2000 as amended."
