TAKING IN CHARGE OF ST FINIANS ROAD, NEWCASTLE - FOR APPROVAL
This headed item is seeks the Council's approval on the proposal to take the roads listed in the roads schedule and the infrastructure detailed in the taking in charge map on St. Finian's Road into the charge of South Dublin County Council.
The following Taking in Charge public notice initiated a public consultation process with publication in the Council's portal and in a local newspaper. The public consultation took place between the 19th June 2025 and 14th August 2025.
Public Notice:
"In accordance with the provisions of Section 11 of the Roads Act, 1993, South Dublin County Council hereby gives notice of its intention to consider the making of a declaration that the roads listed hereunder be a public roads.
(As this road was developed as part of the St Finian’s school project it is therefore also proposed to name the road as below).
St. Finian’s Road, Newcastle South, Newcastle, Co. Dublin.
In accordance with the provisions of Section 180 of the Planning & Development Act 2000 as amended, the Council considers the Taking in Charge of the green areas, sewers, watermains, storm drains and public lighting within the attendant ground of the development.
Please note that green areas will be Taken in Charge and cut by the Council.
This matter will be considered by South Dublin County Council at its Council Meeting on 13th October 2025.
Maps showing the roads and the areas to be taken in charge, will be published separately and will be available for viewing at the Council’s public consultation portal at http://consult.sdublincoco.ie from 19th June 2025 until 14th August 2025.
Objections or representations regarding the above proposal could have been be made via the portal or in writing to the Senior Executive Officer, Land Use, Planning and Transportation, South Dublin County Council, County Hall, Tallaght, Dublin 24, D24 A3XC.
The latest date for receipt of postal objections or representations via the portal was 14th August 2025."
Submissions Received:
No submissions were received during the prescribed consultation period referred to above.
Executive Recommendation: The Finian's Road, footpaths, public lighting, storm drains and green areas are constructed to South Dublin County Council's taking in charge standards.
Clondalkin, Newcastle, Rathcoole, Saggart and Brittas Area Committee Post Public Consultation Discussion:
The Area Committee discussed this taking in charge proposal on the 17th September 2025. The committee noted the details of the proposal and recommended that the item be brought to full Council on the 13 October 2025 for final decision.
TIC Approval Decision:
This Headed Item seeks the approval of this Council to "Take in Charge the roads detailed in the roads schedule and the infrastructure detailed in the Taking in Charge map on the St. Finian's Road, Newcastle in accordance with the provisions of Section 11 of the Roads Act, 1993 and in accordance with the provisions of Section 180 of the Planning & Development Act 2000 as amended."
