MOTION NO.6

MOTION: Councillor M. Duff

"This Area Committee calls on the Manager to instruct Cellnex to remove the Mast and associated Cabinet, located on Tymon North Road (planning ref S25419/08) when the three year Final Grant permission extinguishes on the 30th March, 2025?"

REPORT:

 It is noted that License Application S25419/08 was appealed to An Bord Pleanala and the Board granted a license with a 3-year duration on 30/03/22. Unless a further license is issued in the interim, this license will expire on 30/03/25 plus 27 days to cover the additional 9 days per annum for the Christmas period. The onus is on the license-holder to comply with the conditions of the license. It would be premature to issue instruction to the license-holder at this time. Should the mast and related cabinet remain in place beyond the period of license, planning enforcement would issue a statutory Warning Letter under Section 152 of the Planning and Development Act 2000, as amended to the license-holder following the receipt of a complaint.
