MOTION NO.1
MOTION: Councillor M. Lynch
That the manager prepares a report on the possibility of taking in charge the roadway / laneway that runs from from Scoil Naomh Padraig's National School to Saplings school which is used extensively by school children and is in bad repair.
REPORT:
The laneway/roadway is a privately owned roadway. The Laneway in question has limited public utility. That is it benefits a couple of private business and the GAA grounds. The roadway is also currently in a poor condition and would cost significant amount of money to upgrade to a Taking in Charge standard.
Section 11. Roads Act 1993
(b) Where a road authority proposes to declare a road to be a public road it shall— |
(i) satisfy itself that the road is of general public utility | ||
(ii) consider the financial implications for the authority of the proposed declaration |
It is the opinion of the Roads Section that the laneway is not of general public utility- only serving particular businesses and a particular sports association.
And the cost implications for the Council to upgrade the existing laneway to a safe and maintainable standard would be significant.
Therefore, this laneway should not be Taken in Charge by South Dublin County Council.
