MOTION: Councillor D. McManus
That this area committee asks the Chief Executive to examine the deterioration of the riverbank at the rear of properties between(Address provided) the riverbank has been deteriorating for some time following the collapse of gabions that were originally installed before 1994, and how such work could be done to restore the rear gardens of these properties, and prevent impact to other nearby properties?
REPORT:
SDCC have carried out investigations and have previously met the landowners where the riverbank is located. It should be noted the Council is limited to the performance of its functions in this matter in accordance with relevant statute. The Office of Public Works as lead agents for flood risk management, have published guidance in relation to riparian rights and responsibilities, “A guide to the Rights and Responsibilities of Landowners (January, 2020)”. As the riparian owner, the guidance states the landowners in question have “the right to protect your property from flooding, and your land from erosion. However, you should consult and agree with your Local Authority the most suitable course of action prior to undertaking any maintenance works.”
SDCC is available to review, and where possible, offer advice to the suitability of the measures proposed by the landowners prior to any works commencing.
