QUESTION: Councillor M. Duff

"Would the Manager make a report to this Area Committee regarding the rules and processes, applied by South Dublin County Council, for any external changes to premises in the ACA area of Tallaght Village, such as signage, window name logos or wall murals and to detail what is an acceptable change to premises within the ACA?"

REPLY:

Please note a mural always requires planning permission. Please also note the Planning and Development Regulations 2001 (as amended) sets out a range of size-based exemptions for signages (known as advertisements) that are exempt from the requirement to obtain planning permission. However in an Architectural Conservation Area (ACA), where any of these signs may have an affect on the special character of the ACA, planning permission is required. Oftentimes signage in ACAs requires planning permission even though outside an ACA, permission would not be required. Determining whether an sign needs planning permission is done on a case-by-case basis rather than relying on specific rules. This is known as a Section 5 Declaration and is a statutory process. Applications for planning permission within an ACA will be considered against the conservation policies set out in the County Development Plan having regard to the nature of the proposals and the special character of the particular ACA. In considering applications within ACAs, we would also rely on the expertise of our Conservation Officer in making decisions.
