QUESTION: Councillor M. Duff
"The issues of private cars using the Bus Gate on the Old Blessington Road was raised at the August meeting of the Tallaght Transport Forum. Bus Drivers complain that a recent issue of a private car, braking without warning at the Bus Gate, caused the bus driver to carry out emergency braking and by doing so, caused a passenger to suffer serious facial injuries. This Area Committee calls on the Manager to install CCTV with NPR facilities at the Bus Gate in an effort to fine and deter any unauthorised vehicles from illegally using this Public Transport facility. *Please copy to the Tallaght Area Traffic Management Meeting for September?"
REPLY:
It should be noted that the Council does not have a remit in the management of the public transport facility, or for management and / o9r enforcement of matters relating to motorists' behaviours.
Members should also be aware that footage or images containing identifiable individuals captured by CCTV systems are personal data for the purposes of data protection law, and while in accordance with Section 77A (new) of the Roads ACT 1993, a roads authority may set up and operate cameras and other data gathering devises, there must be a clearly defined purpose for installing CCTV and there must also be a defined legal basis under Article 6 GDPR for such use.
