Subject: Section 254 Licenses - South Dublin County Council - Tallaght Area Committee Meeting
Dear Minister O’Brien,
I write on behalf of the Elected Members of Tallaght Area Committee who, at their May 2023 meeting, passed the following motion.
I also provide details of the report provided by the executive at that meeting.
MOTION:
This Area Committee calls on the Minister for Housing, Local Government and Heritage, Darragh O'Brien TD to amend paragraph 6 subsection (a) of Section 254, Planning and Development Act 2000 to include a requirement, in the event of an appeal against the granting of a licence for a Telecommunication Mast, that all works, granted by such a licence, cease until the Appeal process is concluded by the Board?"
REPORT:
The motion by Councillor Duff is noted. It is also noteworthy that Section 254 (6)(a) of the Act that Councillor Duff refers to does not contain a time-limit in relation to the appeals process and as such a license may be appealed at any time during its lifetime.
If motion is passed, details of the motion will be forwarded to the Minister for his attention.
