QUESTION: Councillor Shane Moynihan
To ask the Chief Executive as to what regulations are in place to protect boundaries identified as protected under the County Development Plan, and how such regulations are enforced.
REPLY:
The Development Plan is a policy document and does not provide for any regulations. Where the protection of certain boundaries is identified as an objective in the Development Plan, for instance by way of a specific local objective, it will inform the assessment of a relevant planning application. Protections are also afforded to protected structures listed in the Development Plan. Their boundaries will be assessed as part of any planning application involving a protected structure where relevant.
In general, issues relating to boundaries are a civil matter. However, where planning permissions have been granted which provide for boundary retention or specific boundary treatment and there is concern that this is being breached the Enforcement section of the planning department should be notified.
