QUESTION: Councillor M. Duff
"Could the Manager inform this Area Committee as to what power the Council has in respect of enforcement where Commercial Bins, at the rear of commercial premises, located on SDCC land, remain unsecured and uncollected for long periods of time?"
REPLY:
The Council’s Waste Enforcement Officers powers stem from Section 14 of the Waste Management Act 1996, as amended. They have additional enforcement powers under the ‘South Dublin Council Household & Commercial Waste Byelaws 2018’. Section 2.3 prohibits containers used for the presentation of kerbside waste being stored in any public place unless that has been expressly authorised in writing by an authorised person – i.e., a person authorised by SDCC or a Garda. A fixed penalty notice of €75 may be issued where a person is found to have contravened the byelaws.
Byelaws are expected to assist as part of a wider suite of measures including extensive education/awareness initiatives in ensuring lasting behavioural change in how we as citizens manage our waste.
