Can management update on the current direction from Government regarding Strategic Housing Development applications? Numerous large scale SHD's continue to be presented at Area Committee Meetings despite the indications from Government that this form of planning application was to cease. REPLY:
The new Large Scale Residential process was introduced by the Planning and Development (Amendment) (Large-scale Residential Development) Act 2021 (No. 40 of 2021) to replace Strategic Housing Developments (SHDs) and came into effect on December 17th 2021. The Act included a number of transitional arrangements in relation to the expiry of the SHD arrangements and their replacement by the new Large-scale Residential Development (LRD) arrangements.
Under the Act:
The second bullet point is most relevant as essentially, SHD schemes at Stage 2 (pre planning with ABP) prior to December 17th 2021 were able and have continued to come in as SHD applications to ABP in 2022. An Bord Pleanala have experienced delays in issuing Stage 2 opinions (pre planning with ABP) and as such, the full expiry of the SHD is delayed as SHD applications can come forward within 16 weeks of the ABP opinion on sites that were in the system prior to December 17th 2021. The Planning Authority do not foresee many more SHD applications coming to the ACMs in this County.
