QUESTION: Councillor M. Árdagh
"To ask the Manager for a report on the site of the former Greenhills Shopping Centre following on from the Headed Item presented to TRAC 1 on 6th Dec. last and to state what action the Council has taken under the Derelict Sites Act 1990 to date?"
REPLY:
A further reply issued on this matter at the meeting of the Committee held on 4th April, 2006 as follows:
At the Meeting of Terenure / Rathfarnham Area Committee (1) on the 6th December, the members were informed that Planning Permission was granted by the Council in April 2004 for the construction of a three storey basement retail / apartment building at this location. The site is being monitored, but to date no commencement notice has been submitted, indicating that it is proposed to implement the Planning Permission Granted, and the Council cannot force the developer to do so.
Following further inspections of the site maps / drawings are currently being prepared, and as soon as these are available it is proposed to commence the procedure to acquire the site by Compulsory Purchase Order under the Derelict Sires Act 1990. This procedure involves giving notice of the Council's intention in the press and serving notice on the owners. If objections are received, the matter must be referred to An Bord Pleanala for decision. There is no time limit in the legislation for the Bord to confirm the Compulsory Purchase Order, accordingly it is not possible to establish a timeframe for the completion of the acquisition. If the Bord confirms the Compulsory Purchase Order, and the Council are successful in acquiring the site, consideration must then be given to its future use.”
It is anticipated that the procedure to acquire the site by Compulsory Purchase Order under the provisions of the Derelict Sites Act, 1990 will commence within two weeks.
