"That the Manager present a report for the consideration of this committee regarding the action which the Enforcement section now proposes to take following the outcome of the appeal to An Bord Pleanala in the Landy's Estate mast case."

REPORT:

An Bord Pleanala by decision dated 12th April 2006 upheld the Council's decision to refuse planning permission to retain the following proposed development; "Erection of a replacement 12.5m high guyed pole on roof carrying 3 no. antenna and 1 no. relocated existing antenna, associated equipment, outdoor cabinets and 1.1m bollards." on lands at Landy's Industrial Estate, Knocklyon Road, Knocklyon, Dublin 16. An Bord Pleanala’s reference number PL 06S.214393 and Planning Authority Register Reference SD05A/0590 refers.

Accordingly, a Warning Letter dated 24th April 2006 pursuant to Section 160 of the Planning and Development Act 2000 has been served on the owner and occupiers of the above lands requiring the removal of the unauthorised mobile telecommunications antennae, support mast, equipment housing and associated equipment from the above lands within 21 days of the date of the Warning Letter.

Failure to comply with the above request may result in an application to the Dublin Circuit Court by the Council seeking a Planning Injunction under Section 160 of the Planning and Development Act 2000 seeking a cessation of all unauthorised developments on the lands.

The Councillor will be kept informed as this matter progresses.
