Proposed amendment of penalties for non compliance with the control of parking bye-laws Lucan 2004 and the control of parking Bye-laws Clondalkin Palmerstown Rathcoole Rathfarnham and Saggart

Following the introduction of fixed charge offences by the Minister of Transport Martin Cullen on the 3^rd of April 2006 it is now proposed that the Control of Parking Bye Laws Lucan 2004 and the control of parking bye-laws Clondalkin, Palmerstown, Rathcoole, Rathfarnham and Saggart be amended to take account of this change. It is proposed that Schedule 1 be amended from:

‘Penalty for non-compliance with Bye-Law €19.00’

to read as follows:-

‘Penalty for non-compliance with Bye-Law to be a fixed charge of €40.00 if paid within a 28 day period commencing on the date of the fixed charge notice. The penalty due will be increased by 50% (€60) if paid within the 28 day period beginning on the expiration of the afore mentioned period.’

The making of bye-Laws is a reserved function of the Council and a report in these terms will be brought to the next Council meeting.
