MOTION NO. 12

MOTION: Councillor Shane Moynihan

That the Chief Executive seal the laneway behind Culmore Road, given the support for such a measure by the vast majority of residents, to avoid anti-social behaviour.

REPORT

It should be noted that none of the laneways are not in the ownership of the Council.  However, there is a public right of way throughout.

It is a function of the Council to protect the right of the public to use public rights of way in its administrative area.

If the right of way is extinguished, then the land will revert to the owner.

Residents would then be required to negotiate with the landowners for access to their back gardens.
