QUESTION: Councillor K. Egan

"To ask the Council to confirm the process in South Dublin County Council for licencing as set out in the Gaming and Lotteries Act 1956 and outline any changes being proposed or made to the licencing or regulation of Amusement Arcades in the county."

REPLY:

The Gaming & Lotteries Act 1956 (as amended). Section 13 of the Act states :

13.—(1) A local authority may by resolution adopt this Part in respect of the whole or a specified part of its administrative area and may by resolution rescind such adoption.

Dublin County Council, the predecessor of South Dublin County Council, rescinded in 1989 its previous resolution to give effect to Part III of the Gaming and Lotteries Act 1956 and consequently certificates for premises cannot issue in the functional area of the Council as Part III is not in force.

The 1956 Act was amended significantly with the introduction of the Gaming and Lotteries (Amendment) Act 2019, but Members of South Dublin County Council have not formally adopted Part III of the 1956 Act in respect of the South Dublin County Council Area.
