MOTION: Councillor Eoin Ó Broin

"The response to Members Reps. ID: 1656195 on 20/07/2021 stated that 'The hedging referred to is growing in private property and South Dublin County Council is obliged to issue a Notice to the property owners in this regard. This process will commence following inspection and report from the Roads Inspector'. Three months later the hedge at Floraville Cottage on the south side of the Monastery Road which is blocking the footpath has still not been trimmed. This delay suggests that there is more respect for the rights of the property owner who has not maintained the hedge versus the citizens of Clondalkin who cannot walk on the footpath because of the hedge. That this Area Committee receives an explanation for the delay with having the hedge trimmed and a timeline for how this matter will be addressed."

REPORT:

Following inspection, it was found that Floraville Cottage is not being lived in and is the subject of a Planning Application. A Hedge Cutting Notice was sent on 15th September to the company who submitted the Planning application as we were advised nobody lives at the property. The company has 28 days to reply to the letter.

It was then decided to send the letter to the Planning Consultant. They acknowledged the letter and within a day the hedge had been cut. 

I think this demonstrates that Road Maintenance are not prioritising private property, just respecting the Wildlife Act and the Roads Act.
