MOTION: Councillor G. O'Connell, Councillor P. Gogarty, Councillor L. O'Toole

• To amend matrix zoning that the land use type 'Embassy' be removed from the HA zoning.

REPORT:

Embassy use is currently ‘Not Permitted’ in the HA zones.  The motion seeks to remove the ‘Embassy ‘use class from these zones.  As all use classes are located under one of the three categories ‘Permitted in Principle’, ‘Open for Consideration’ or ‘Not Permitted’, the effect of this would be to require the removal of this use class from every zone.  This would not be appropriate – ‘Embassy’ is a use class defined in the Development Plan. 

However, it is recognised that part of the village of Lucan lies within the HA-LV zone and that there are existing buildings within this area which are currently in use as the Italian ligation.  In recognition of this, it is considered that the use-class ‘Embassy’ should be included in the ‘Open for Consideration’ category with a caveat to indicate that this should be in existing premises only, in order to protect the sensitivities of the HA zonings.

RECOMMENDATION: 

It is recommended that the motion is adopted with amendments to move ‘Embassy’ from the category ‘Not Permitted’ to ‘Open for Consideration’ with the caveat (a) ‘in existing premises’ within the HA zonings (HA-LV, HA-DV and HA-DM).
