MOTION: Councillor G. O'Connell, Councillor P. Gogarty, Councillor E. Ó Broin, Councillor L. O'Toole
It shall be an objective of the County Development Plan 2022 - 2028 that SDCC investigate, secure, signpost and open up to the public the traditional right of way from the cottages on the Old Street, Mill Lane, Palmerstown, to where it enters Waterstown Park and from Waterstown Park to Hermitage Golf Club with a footbridge over the Liffey at this point to continue the right of way along the Strawberry Beds..
REPORT:
The provisions of EDE23 Objective 2: sets out a process for creation of Public Rights of Way. These are set out below. Individual proposals for the creation of public rights of way will be considered as part of the steps set out in EDE23 Objective.
EDE23 Objective 2
To identify, in a logical and sequenced way, existing public rights of way in relevant
areas of the County and to investigate the creation of new public rights of way by taking the following steps
within two years of adoption of the Plan:
mountain, lakeshore, riverbank or other places of natural beauty or recreational utility.
understanding that a public right of way may exist undertake the necessary steps for consultation set out
in the Planning Acts.
rights of way agreements available under section 206 of the Planning and Development Acts
orders under section 207 of the Planning and Development Acts.
The PRW requested in this motion will be investigated as part of that process. This is to ensure that all proposals including that referred to in this motion are methodically investigated.
Recommendation
It is recommended that the motion be amended reflect that the intent of the motion is addressed through the provisions of EDE23 Objective 2
