Question No. 1

MOTION: Councillor M. Duff

This Area Committee calls on the Manager to make a full report about residents complaints about the draining of a natural wetlands habitat, at the lands now known as Newlands Farm. If these actions are indeed proven and illegal works are being carried out on this Wetlands, that this Area Committee calls for those responsible to be prosecuted to the full extent of the law.

REPORT:

Following receipt of a complaint a Planning Enforcement file was opened on 31st May 2021.  A warning letter dated 1st June 2021 was issued to the owner/occupier in relation to an alleged unauthorised development at Lands at Newlands Farm.   

As a person served with this letter, the owner/occupier may make submissions or observations in writing to the Planning Authority regarding the above, (which, if true, could constitute an offence under the Planning and Development Acts, 2000 (as amended) not later than four weeks from the date of the service on the owner of the Warning Letter, i.e. 1st July 2021.  Once the date for submission has expired, the file will be referred to our planning inspector for site inspection. Should the Planning Authority , following investigation , consider that unauthorised development has been / is being / may be carried out, it may decide to issue an Enforcement Notice under section 154 of the Planning and Development Act 2000 (as amended).

Any person who has carried out or who is carrying out unauthorised development may be guilty of an offence under section 151 of the Planning and Development Act 2000 (as amended) and shall be liable to a fine or imprisonment.
