Page 225 That the plans insert an SLO on the lands earmarked for the Esker Community Initiative as mapped out in the attached document, to ensure the any development on this land is for community recreational purposes.
REPORT:
The Planning Department consulted with the Economic Development Department on this motion. The Economic Development Department have commented that they have been in engagement with the schools and the parish in respect to using Council owned lands as part of the further development of schools in addition to securing a wider beneficial community use for the subject lands. To this end the Community Department has engaged with the Esker Community Initiative to assess the wider community benefit, it is hoped to come to an agreement with the parties involved and once the terms and conditions are agreed it will be subject to the approval of the members in accordance with the provisions of Section 183 of the Local Government Act, 2001 and in accordance with Section 211 of the Planning & Development Act, 2000.
On this basis it is considered that this matter will be further dealt with through the relevant procedures noting that these are subject to the reserved functions of the Members. However, subject to amendment, it is considered that an SLO can be placed on the lands.
Recommendation: It is recommended that this motion is adopted with amendment to read:
