MOTION: Councillor Shane Moynihan

To amend the Development Plan to include a new objective in Chapter 5 - QDP 6 Objective 5 "to ensure that waste or derelict ground or unused ground in the ownership of the Council is secured and restricts access to prevent anti-social and criminal behaviour"

REPORT:

The Derelict Sites Act, 1990 (as amended) sets out the legislative requirements and processes in relation to ‘Derelict Sites’.  Chapter 2 section 2.6.7 sub heading Vacant Sites refers to Derelict Sites as follows:

“Derelict Sites can have a negative impact on the social, visual and commercial aspects of

a neighbourhood. The Council will investigate reports of dereliction and take relevant action, in accordance with the Derelict Sites Act 1990 (the Act), in an effort to have the dereliction abated and ensure re-use of existing urban lands throughout the County”.

Lands in the ownership of the Council are subject to the provisions set out in under the Derelict Sites Act 1990. Section 9 of the Act states:

“9.—It shall be the duty of every owner and occupier of land, including a statutory body and a State authority, to take all reasonable steps to ensure that the land does not become or does not continue to be a derelict site.”

Given the above it is considered that the proposed objective is already covered within legislation and is not required to be included as a new objective in the Draft County Development Plan.

Recommendation

It is recommended that this motion is not adopted.
