Page 77 CE draft plan Policy NCBH 11 Objective 2 To identify trees of amenity value within the County and use whatever mechanism is available for their protection. Replace with To identify trees of amenity value within the County and to establish a defined mechanism that can provide for their protection.

REPORT:

The proposed motion seeks to amend the wording of Policy NCBH 11, Objective 2 to ‘To identify trees of amenity value within the County and to establish a defined mechanism that can provide for their protection.’

It should be noted that establishing a mechanism for the protection of trees does not fall under the remit of the CE Draft Plan. Such mechanisms are set by legislation, such as Tree Preservation Orders (TPOs) made under Section 205 of the Planning & Development Act 2000. It is considered that the CE Draft Plan has made provision for preservation of trees and woodland and as such it would be inappropriate to amend Policy NCBH 11, Objective 2. The objective provides for the use of any further mechanisms that may become available should that arise. Therefore, the proposed motion wording is outside the remit of the Development Plan.

It is noted that motion id 71059 also suggested amended wording which has been recommended for approval. It is considered that this would meet the intentions of this motion and appropriately strengthen the objective. “To regularly evaluate and identify trees of amenity value within the County with a view to making them the subject of TPOs or otherwise protecting them and further, to furnish information to the public in this regard.”

Recommendation

It is recommended that this motion is not adopted.
