QUESTION: Councillor Eoin Ó Broin

"To ask the Chief Executive if the planning authority of South Dublin County Council erred in 2012 in not including as a condition of planning, reuse of the stone from the stone wall that once stood at the junction of Boot Road and St. John's Road in Clondalkin, in the planning permission granted for the Primary Care Centre (SD11A/0135)? The South Dublin County Council County Development Plan for 2010-2016 had as Policy AA2: It is the policy of the Council to secure the preservation of all sites and features of historical and archaeological interest."

REPLY:

The Planning Authority assess each proposal on their merits in accordance with Section 34 of the Planning and Development Act 2000. When making its decision in relation to an application under this section, the planning authority shall be restricted to considering the proper planning and sustainable development of the area, regard being had to a number of criteria, including the provisions of the development plan. The assessment of a planning application requires the careful balancing of compliance with the Development Plan and there are sometimes sites and proposed developments where the delivery of the polices of the Development Plan can conflict. For example, in the subject application, the preservation of the existing features, the delivery of infrastructure for sustainable modes and urban design considerations such as the creation of improved public realm. The Chief Executive’s Report and the Board’s Inspectors report provide the rationale and reasons for the decision in this planning application.
It is noted that the subject planning application was granted following an appeal to An Bord Pleanala.
