QUESTION: Councillor S. O'Hara
"To ask the Chief Executive the large green area outside the C of I church gates in Newcastle - it is Council land but C O I have been maintaining it as wasn't being done by the council and looked very unkempt - however, the congregation is getting older and some of the people who looked after it is no longer able for it - Can the council take responsibility for it as it is their land."
REPLY:
The area of land referred to in the question is not recorded as being in the charge of the Council. The Public Realm section don’t currently maintain it as indicated. There is no record of the Council ever acquiring an interest in these lands. Currently, it is not possible to perform land /title searches in Registry of Deeds as it is closed to the public, this might yield some relevant information.
The Council have referred previous enquires about the lands to the front of the church to the Church of Ireland / The Representative Church Body but have received no replies. If any documentation is available through the Church Authorities, the Council would be happy to examine same with a view to clarifying ownership.
